Can i get a implied status work permit?

Hey everyone,

i'm a british citizen that originally came here on a IEC
i married a canadian and we have just sent the paperwork for PR and a New work permit ( i do not have a degree etc so would not have enough points )

However, does anyone know if i can get some kind of implied status from my previous SIN/IEC Visa so i can go back to work because the current waiting time is around 5 months for a work permit and i hate not participating in the financial department, feeling like im losing my mind not being at work

My old job also called to ask if i have a new permit yet as they want me back... it's such a pickle of a situation

When did your IEC expire?

Did IRCC receive your spousal sponsorship application and the OWP application before your IEC expired or after?

OWP processing is 8+ months right now.

My IEC expired in april but i am currently under my second visitor record so im under legal status

they would of received the OWP and PR after

8 months! how can people survive?

In that case you have implied status to remain in Canada as a visitor only. You cannot work until the OWP is approved. The only other alternative would be to find a way of securing a closed work permit. This would require your employer to obtain an approved LMIA which is a months long process (and also expensive for the employer). You can still go this route if your employer is willing - but it unfortunately won't be fast.

In terms of how people survive, the primary thing people do is ensure the spousal sponsorship application + OWP is submitted to IRCC before their work permit expires. If you do that, you have implied status that allows you to continue working. Otherwise they have to plan for a period of unemployment.

We could barely even get a slot to get married due to covid and by the time we could, my visa had expired..

Sorry to hear about the LMIA but good that you explored that.

In that case your only option is to wait for the OWP to be approved. You won't be able to work until then.
