Good day,

Let's assume an FSW-O candidate gets an invitation when he has completed only 33.5 months....on date X

If he submits his application in 2.5 months( 75 days) on date Y.....He would finish 36 months of work experience by that date

Can he get the maximum points on Foreign work experience if he has completed his work experience's 36 months, in the 90 days after he received his Invitation?

Also since the portal calculates the work experience points month wise...i am a bit worried about the eligibility criteria

The EE portals assmes you have started working on 1st January (as an example) if you say you were working from Jan to may....and ended your work on 31st May.

When a candidate’s situation changes after the ITA is issued
Candidates are responsible for ensuring that the information in their Express Entry profile is up-to-date and accurate at all times.
Candidates’ Express Entry profile is automatically “locked” when they are issued an ITA.

I agree
So you are saying
Declide the ITA if you dont deserve it?

Assuming that i am a week away from getting 3 year work experience....should i just decine the ITA?

OR

Should i wait a week and then accept the ITA after i complete my 365 X 3 days....

No dear, you surely earned it since you have received it.
Its not me its IRCC says: GCMS first capture of your data happens on your ITA issuance. Meaning what ever ages afterwards does not counts; for example if you have your birthday right after your ITA your CRS won't drop because the system has already locked on your provided data.

If it is only one week it should be ok do not decline, because the system interpret your experience in terms of months and working hours per year.

What is your stream ?

at least 1 year of continuous work or 1,560 hours total (30 hours per week)—you can meet this in a few different ways:
  • full-time at 1 job: 30 hours/week for 12 months = 1 year full-time (1,560 hours)
  • equal amount in part-time work: for example 15 hours/week for 24 months = 1 year full time (1,560 hours)

Thank you for the information..:)

I am FSW-O.
I already meet the minimum criteria...if that makes any difference.

However i have had paid vacations(which is quite unique to my job since we work without a break for 6 months a year including sundays)...i get a paid vacation at the end of this 6 month tenure where i am home and i can relax a bit.

This vacation is fully paid...
Now i wouldn't bother much about if but my travel history will show them that i have arrived home.

Also i have this travelling spirit...:p..and during this one month i used to go around a lot...so i have further personal travel history....not related to work.

So basically i got a lot of proof which will tell that them i am not doing anything related to work during this paid duration and then i am back into hot oil again for six months.

I have a total of 32 months of hot oil period when i am working up to 10 hours a day without a sunday
and a total of 9 months when i am home, chilling and drinking beers....basically doing nothing related to work

so i am going to get another job soon.....where i hope to cover 4-5 months of work experience before i get an ITA in October..:p

I am secretly wishing for no ITA for FSW applications till October..:p

How evil..:p

What is your opinion now?

I will start this new job on the 1st of june....but i don't know if i will be able to complete 5 months before i receive the ITA or not.

Technically i have completed the 3 year work experience already but that is left to the Visa officer to decide whether my period home, which was paid is still work experience or not.

People get weekends/ teachers get summer breaks/ i get these month and a half off....

All you need is reference letter that states your:
Your full name as per passport
Designation
Duration (no gaps no lay off i mean, annual leavs are irrelevant and should be ok)
Gross salary plus incentives if any
Hours per week
Full detailed Job duties
Company stamp
HR signature
HR contact full details ( phone, email, mail. Etc...)

All on one company letter head paper.

You need one reference letter for each job you mentioned even if in same company.

See:
Proof of work experience
Purpose
To prove each work experience claim and to validate that the applicant meets program requirements
Document requirements

Note Bien: never under estimate IRCC criteria, never get lazy complying and adhering to their requirements they are very serious about it no matter how simple or even silly the requirements look to you the rules are there for reasons. Just follow any instructions you encounter by book and max accuracy possible.

Minimum criteria is one year in the past ten years. You have 3 years duration. So as long as you meet working hours requirements i guess yes.

Experience should be full time not less than 30 hrs per week during each year.

They do not count hours after 30/week meaning you can't combine two years in reference to one year duration with doubled cumulative hours, unless those are part times 15hrs per week. Ex: 3120hrs in a year or even 18 months duration are still one year experience.

But a situation where in

a guy was employed from xx/xx/xxxx to yy/yy/yyyy which equals to 365 days.

His letter says so

But he had a 2 month fully paid vacation in between, over seas.

What would be the implications if he had covered the 1560 hours requirement?

My working hours were 40 hours per week in all these jobs
