Extreme Confusion regarding Canadian Education points

Hi all,

I am in a complete dilemma and even several ICCRC Agents I inquired to are not able to provide accurate information to me.

I have done a Bachelor of Computer Applications (3 years Degree) from a University in India for which I have already received WES Evaluation Report stating it as a 3 years Bachelors Degree. All is good so far.

After this, I took admission in George Brown College (GBC), Toronto, Canada in the Computer Systems Technology (T147) Advanced Diploma Program. GBC has an official tie-up with my University in India due to which they gave me a transfer of credits and a lateral entry directly into the second year of the program.
I have graduated and my GBC Transcript states that they have given me an "Advanced Standing" for the first year of the course. My official Diploma issued also says it is an Ontario College Advanced Diploma (which is of 3 years).


The Confusion :

I am now applying for Express Entry under FSW and not sure how many points to claim specifically under the "Study in Canada" section. As an Advanced Diploma is considered a 3 years course (Although I studied for only 2 years in Canada), am I still eligible for 30 points under Study in Canada or only 15 points?

Technically, since they have asked for level of education (not years) obtained in Canada, it should be 30 points. However my ICCRC Agent has falsified my claim and considered this as a 2 years 15 points Diploma as I studied in Canada only for 2 years.

My claim: Had it been Number of Years of education required in Canada, I would have agreed with 15 points. But they are talking about the level of education obtained which should be 30 points for an Advanced Diploma?

After inquiring with many different consultants/friends in and outside of Canada I am hearing conflicting reports.
If anyone could help me with this, I would very much appreciate. I do not want to misrepresent myself in front of IRCC or gain any unfair advantage over other hard-working candidates in the Express Entry Pool.

I have tried to explain them that number of years is a different aspect while level of education earned is a different thing. It is quite confusing.

Ok i could have found the rule of PG work permit for you but still cannot tell if it applies for FSW,


Transfers between educational institutions
In cases where a student has transferred between eligible Canadian DLIs, the combined length of study must be at least 8 months to qualify for a post-graduation work permit.

In cases where a student graduated from an eligible DLI after having transferred from an ineligible institution, only time spent at the eligible DLI counts as eligible for post-graduation work permit issuance. Time spent at the eligible institution must be at least 8 months.


Programs with an overseas component
If a student completes a program of study in Canada that has an overseas component, they are eligible for the PGWPP, as long as they earn a Canadian educational credential from an eligible DLI. However, the length of the post-graduation work permit is based on the length of time they studied in Canada. Officers may contact the DLI to confirm that the studies have taken place in Canada.

I am not sure if PGWP rules would also apply to a Permanent Residence application.
But if it does, then I should only be receiving points for the duration of time-period studied in Canada (which is 15 points in my case) and not for the level of Canadian education earned.
