I received mail from IRB that my claim might be accepted without hearing. I see that many refugee claimants have received that. I told my lawyer but she is advising me not to go through this route. It looks like her main reason is that she is too busy.
Can anyone please tell me their experience? Did you guys at all consult your lawyer on this or do you send your documents and certification of readiness form on your own?

Your lawyer is giving you good advice. Being considered without a hearing is usually a very good sign.

She is telling me to not to do it. I don’t know why. Have you gotten yours yet and did you talk to your lawyer about it?

maybe your lawyer wants to charge you more by going to hearing because it requires more time and preparation.. if i were in your position i would definitely change lawyers because it is either your lawyer is insane or there has been miscommunication between the two of u

Did you receive from IRB after you eligibility interview or directly ?

When IRB officially marked your case as less complexed you should go with it, any other thing will make your case processing delay

You should consider that route, but it may take time to get decision provided your scheduled hearing is close. My lawyer prepared argument for the file review without hearing but I preferred to go for hearing and we later agree to go that way. Its a positive sign to be considered for file review but timing matters, it made no sense two months before scheduled hearing to make that submission, and I think we both were right...I don't see being too busy as the reason not to accept that route, as she'll need to be prepared anyway for the hearing...

Would obviously follow your lawyer’s advice. Unless there is obvious evidence why you should be denied asylum, people being offered an answer without a hearing are usually approved. Your lawyer obviously has access to your whole case history not the forum. Is this a private lawyer or legal aid? Do you come from a country that has high asylum approval and do you qualify for residency in another country? Did you arrive directly from your home country or did you live elsewhere? File for asylum elsewhere?
