Hello ,
I know the border has been closed since March 2020 for NON-ESSENTIAL TRAVEL . I would like to know if this does apply to people in the US who want to seek asylum in Canada at the border.

Does "Non-Essential" apply to asylum seekers ?

Please if you do know for sure let me know as this is a life-changing decision for me ,

Yes - restrictions apply to asylum seekers.

Right now Canada and the US are not allowing asylum claims at the border due to the pandemic. If you try to claim asylum at the Canadian border now, you will be returned to the US.

I have read that restrictions will be lifted on May 21.
Thank you for your quick response.
Most likely the restrictions will be extended by a month again. Each month the government assesses the situation and then makes an announcement about extending the restrictions by another month.

In the current economic conditions, US don’t have to seek refugee or asylum. What’s the use in loosing your freedom? I’m sure going homeless is bad, but people come out of it eventually. There is no guarantee that life is better in other places than your own country. A refugee can never go back and do you understand that? Lots of risk involved. Go to US homeless shelters and stay there and look for a job. All the best.

Does anyone know if this is possible:
Sept 2019 Spousal sponsorship application is in process.
Will the applicant be eligible for a refugee claim?
Will this it affect the spousal sponsorship application since IRCC already has their fingerprints and stuff? Outland
Asking for a closed friend
Any advice will be appreciated. Thank you!

Either enter as refugee or as a spouse. If as a spouse, after entering, take refugee through a lawyer

I don’t get it. The issue is that will they let him in to claim the refugee status while his spousal sponsorship is in process?

Their lawyer said once he’s allowed to come in Canada they will ask to process his Outland application inland instead. Although he entered as a refugee.

2) An intention by a foreign national to become a permanent resident does not preclude them from becoming a temporary resident if the officer is satisfied that they will leave Canada by the end of the period authorized for their stay.
This spousal sponsor TRP can be changed to PR under dual intent scheme. But it does not specifically mention refugee and you have to be there.

Here, your not there yet. So only one process can be followed as spousal or refugee. Not sure about what Outland means sry

Sry I take back what I said above. It actually states that ‘The Immigration and Refugee Protection Act (IRPA) allows one to legitimately have two intents. One can have separate, individual applications for temporary and permanent residence.’ So considering this, they might consider refugee as well.
