@legalfalcon If I transfer my POF funds from one bank to another bank will it create any problem for my visa application? I submitted my application in January 2020. What documents do I need to submit if I transfer my POF funds? Do I have to explain the reason also to visa officer?
You don't need to inform IRCC for this situation

You can transfer your funds to any bank you wish. However, when you transfer the funds, you have to make sure that you keep a record of the transaction so that if IRCC asks for an update PoF, you are able to show that you transferred the funds and still meet the 6 months average balance based on your previous bank, which may not be met with your new bank as you just transferred the funds.

There is no requirement to inform IRCC or send an updated PoF, unless IRCC specifically asks for one. And if you re asked, send an update PoF along with the transaction record of the transfer and an explanation.

Hi again @legalfalcon , sorry I had missed your past answer. To clarify:

1. I'm not sure I understood, would it be misrepresentation or not if I didn't declare my (possible) common-law partner in an application to OINP or EE? I'm not even sure if we qualify and we haven't done the statutory declaration yet.
2.In case my Express Entry application gets denied for whatever reason (e.g. inadequate proof of work experience), would it be ok for us to file a statutory declaration of common-law partnership afterwards so she can sponsor me if I hadn't included her in my previous application as a common-law partner? Or would it lead to misrepresentation since I didn't mention our relationship in the previous application?
1. It is an applicant's responsibility to disclose all information truthfully. So if you are in a CL relationship, you have to disclose it and add your partner to your application and also submit their documents. However, CL relationship is de facto, instead of de jure, i.e. you do not need any legal documents to prove it, like for a marriage.

In the immigration context, a common-law partnership means that a couple have lived together for at least one year in a conjugal relationship [R1(1)]. A common-law relationship exists from the day on which two individuals can provide evidence to support their cohabitation in a conjugal relationship. The onus is on the applicant to prove that they have been living common-law for at least one year before an application is received at CPC-M.

https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/permanent-residence/non-economic-classes/family-class-determining-spouse/assessing-common.html

If you meet the above, you can declare it, but you will have the onus to prove that you are in a CL relationship.

However, many couples who have been cohabiting and meet all the factors of a CL relationship may not see each other as CL partners, which may be duets the nature of a relationship, such as open relationships etc.

It all depends on what you see for yourself, and if you wish to add your partner, or sponsor them at a later date.

2. IF you do not declare your CL relationship now, you cannot change it later. IRCC can check any application you have filed and there should be no discrepancy in all the applications. Eg. if you file an application or immigration an do not declare CL relationship, your CL partner cannot declare you as a CL partner 6 months later, and show that you were cohabiting tother, unless your one test cohabitation started after your application was filed.

Hello @legalfalcon

I am an outland FSW applicant and passed all my stages and just waiting the PPR.

-1- I am planning to go for a short vacation to country X for 25 days then to country Y for 15 days, then I will be back to my country of residence. Should I inform IRCC about these two new addresses and request to change my address once I am in country X, then in country Y, then change it back to my country of residence address? Or since the days spent in county X and Y not so long, so no need to change my address? Kindly help?

-2- If my current address with IRCC is the address of my country of residence, and while I was in country X I got the PPR. Can I send my passport to the visa center at country X? Or before that I have to change my address to an address in country X?

-3- When the visa center receives my passport, usually how many days do they need to send it back to me along with the COPR?

Thanks so much!!

HI @legalfalcon

I got my GMCS notes, and I have recommend passed on eligibility by case analyst. That is good. However, I was expecting to know the sum of points they consider. I submitted a job offer of one year from next September, but I was not sure if they would consider it as valid, since the letter does not say 'from the moment applicant obtains the pr'

See the notes here: https://postimg.cc/FYwd43VF

So how can we know what points I have that they considered valid? I understand that the "CRS score at application" are the points I declared to have, not the points they consider valid.

I am fine without the job offer, but just to make sure everything seems ok

The points that you have claimed are all listed starting from page 8-10.

In the notes, only the documents that are evaluated and reviewed are listed, and as per the note your A11.2, i.e. eligibility is recommended passed.

Now the notes will be reviewed by an officer, who will make a final determination, see #4,004

Once your eligibility is conclusively passed, the security will be initiated. To read on security, see https://bit.ly/3apWglN

Hello @legalfalcon sir,
I really need your help. I had applied for an express entry cec profile and I had claimed 50 points for an lmia and later on that lmia was converted into a lmia based closed work permit because lmia was expiring and to claim those points I had to apply for this lmia based work permit. The situation at my work place was not so good. It was really stressful job and never had a good treatment from the employer. Because of the job offer I wasn’t able to quit the job. I recently got my pr application approved I got my copr over an email. I have applied for my pr card but haven’t received it yet. After few days I just wanted to move out of my work place. I wanted to quit the job. But for some reasons I thought it would be good to give 2 week notice. I spoke to my employer in person regarding my leaving. Now after 1.5 weeks he is asking me to give him a written notice. I have not received my pr card yet. I wanted to have your views on this sir @legalfalcon as I have not received my pr card yet should I be giving him written notice or anything he is planning that made him to ask me for a written notice. Thank you sir. Your expert advice will be appreciated.

As soon as you receive your COPR, effective from he date mentioned on the COPR, you hold a PR status. You do not need a PR Card. A PR Card is only a travel document that you require to travel back to Canada.

As a PR, you can work anywhere, including opening your own business in any part of Canada. IF your employment contracts mandates a written notice, then you will have to provide one.

Info-sharing is part of BGC, which also includes criminality and security. However, it is a quick process. If it says all stages are passed, then surely the info-sharing is passed too.

However, the questions would be, has a decision been made on your application?

Hi @legalfalcon, hope you are great!
have a question:
my PR was approved yesterday, I can see COPR details on CIC porta, but I do not have actual COPR yet.

I am wondering, if I can change employers while I am waiting for COPR?
I claimed 50 points for job offer. However I have another job offer outstanding (no LMIA).

I was on closed WP until Feb 2021, I have approved BOWP.

IF you file two PR applications, the one filed later will be placed on hold until a decision is made on the first one or it is withdrawn. This is done to avoid duplicity of work.

Also, filing a new application will not expedite it or guarantee that it will be processed faster. The new public policy is just another pathway for PR.
Does this apply if I applied via paper-based PNP and I want to apply again either via CEC or the new public policy?
