Hey there, would really appreciate any help we can get. Background on the issue: My Australian partner has been on a working holiday visa for the last 2 years. It expired this past September. Right before it expired, we applied for an extension. The extension resulted in him receiving a visitor record for the past month that expires in one week. We do not want to be separated as I cant get into Australia and he doesn't have the funds to get in (tickets and hotel quarantine). We are just wondering what we can do. Our questions:
1. Can we apply for a visitor record extension. We are hoping to get married and start his spousal sponsorship.
2. With covid, can he leave and get back into Canada on a new visitor visa. Seems unlikely.
3. Should we let his status expire and try to restore it.
4. Do we have any other options.

My question mark button doesn't work hence why they all end with periods. We would greatly appreciate any help. Thank you!

You should apply for an extension. You will need to show that you can support him. Are you common law?

Hey, thanks for the response :) We moved in together in January so it hasn't been a year. After everything I read last night, it seems that we can apply for an extension which is promising. Do you know if its possible to have one granted because we want to apply for an outland pr. We want outland over inland because our plans have always been to go to Australia whenever the borders open up so we don't want to be stuck here with an inland one.

Also, when I go online to fill out the questionnaire for the application package, it asks if he wants to stay for less than 6 months or more than 6 months. Does it matter which one we choose. Thanks again.

Would state that you want to remain together so that you can apply for sponsorship. You can request a year in order to qualify for common law and submit your sponsorship request.

So its okay to ask for an extension and ask them for time to apply for sponsorship even if we are not currently married? Can we ask for a year for outland or only 6 months in that situation?

We thought about common-law but it would mean that we would have to stay here until January before we can apply. And then wait in Canada for the application to be processed. Or can you leave the country while doing a common-law sponsorship?

We are trying to find the best way to begin his PR in a way that allows us to travel abroad should we be allowed to go to Australia when the borders open up. Am I correct in my assumption that we are eligible to apply for outland while we are both living in Canada, and we can both leave Canada during the processing time, but he might have issues coming back before we get accepted since he will not have status under the outland track?

Sorry for all the questions...been researching left and right but this is quite a complex issue. Really do appreciate your help.

Sorry, I have one more question. I was looking at the mail more closely and it says under Remarks and Observations: Temporary Resident Status maintained as per R183(6).
When we go to apply for a visitor record extension, what do we say is his current immigration status. Is it visitor or temporary resident. Thank you, I am hoping to get it done today before the week starts hence why all the questions.
