Lost my father and would like to bring my elderly Mother to Canada on PR

Hi all,

I would like to get some input on bringing my widowed elderly mother to Canada on PR. She doesn't have anyone to take care of her in India. She's 77 and has a visitors visa till Aug 2022. Which would be the ideal way to go?. Applying for supervisa or Is she eligible for direct PR? I don't know how to go about this. Highly appreciate any and all input and if someone how could come up with a tentative timeline as to how long this whole process might take. I'd be grateful as it gives me a clear picture of what to expect.

There is not ”direct PR.” There is a lottery to sponsor parents based on your income. It is once a year and very competitive for the limited number of spots. You need to meet LICO for three years as PR. Some people are never selected to bring their parents to Canada.

You can look at a super visa which is a long term visitor visa.

Thank you for the prompt reply. If it PR is based on income then i don't think i'd meet the criteria as I lost my job in 2020 due to covid. Can my husband be a sponsor for her?.

Can i apply for her supervise in Canada while she's visiting me here?. Or Does it have to be outside the country, rather specifically her home country?.

Can she travel to India and be back in Canada while her super visa is processing?.

Am I allowed to extend her visitor's visa while I'm working on Supervise paperwork from within Canada.

It looks like she has already been visiting you with a TRV for some time. She will need to return to India to apply for a supervisa. Does she have family member in Canada. How many children does she have and where are they located? You may want to care for her but is she able to care for herself like dress herself, cook food, shower, etc. on her own?

Yes your husband can co-sign for both a supervisa and if you get selected for parent sponsorship. Yes she can attempt to visit Canada while her supervisa is processing but it seems as though she has spent quite a lot of time visiting Canada already. Has she returned to India recently? How long has she been visiting Canada in the past few years and how much time has she spent in India? If it appears as though she is living in Canada she could be given a short amount of time to visit Canada if she essentially leaves,applies for her supervisa and returns. She remains a visitor and is supposed to spend time in India as well.

You have to sponsor your mother with your husband as co-signer. It is based on all the people in your household including your mother and any children too. So not sure your household total but you need to meet LICO for at least 3 years. 2021 sponsorship information has not been released. You take on a 20 year financial commitment for your mother.

Super visa has to be applied from outside the country. She can come while being processed. It is based on your family income too.

She has a son and a daughter (PR Canada ), my brother in US (US Citizen) as it appears Green Card takes even longer. She has valid US visitors visa till 2023. if she has to apply for super visa be outside the country, Can my brother from US apply for her?. She can take care of herself her daily routines etc. she gets sciatic nerve flare ups and its quite painful so we do not want to leave her by herself. Also, we are thinking long term she would be best staying with the either me or my brother in US.

She visited Canada in yr 2018 and stayed with me for 4 months (May 2018-Sept 2018) and she hasn't been to Canada since. She got her visitors visa approved in April 2018. My Dad fell sick she hasn't visited either me or my brother since 2018.

So if your mother is in India she can apply for a supervisa now. Your brother can help her fill out the application. Thank you so much. It's definitely comes down to luck, for sure. I, too feel like super visa would be ideal way to go right now at least for the next 3 years or so. she's a beneficiary of my Dad's property back in India.

Supervisa is for 2 years although you can attempt to extend her visitor status. Your mother would also have the option to visit your brother for an extended amount of time after 2 years or return home.
