I am currently in a dilemma. I've already gotten my FBI background check but my documents that I entered the border with (US driver's license, employment authorization card, etc) were seized by CBSA Winnipeg during my entry. I do not possess any documents from my country of origin nor am I able to apply for any since it's authenticity is in question. I was advised by an CBSA agent to make an ATIP request, and I did. Was this the correct step to get an copy of these documents so that I can get a copy of these documents? I am asking just in case he ends up being wrong, since he didn't seem to be too sure when directing me. Below is the message from the IRCC.
Please find below a description of acceptable documents to support your identity:
• A passport, other than a diplomatic, official or similar passport, that was issued by the country
of which the foreign national is a citizen or national;
• a travel document issued by the country of which a foreign national is a citizen or national,
"• an identity or travel document issued by a country to non-national residents, refugees or
stateless persons who are unable to obtain a passport or other travel document from their
country of citizenship or nationality or who have no country of citizenship or nationality;
• a travel document issued by the International Committee of the Red Cross in Geneva,
Switzerland, to enable and facilitate emigration;
• a passport or travel document issued by the Palestinian Authority;
• an exit visa that was issued by the Government of the Union of Soviet Socialist Republics to its
citizens who were compelled to relinquish their Soviet nationality in order to emigrate from that
country;
• a British National (Overseas) passport that was issued by the Government of the United
Kingdom to persons born, naturalized or registered in Hong Kong;
• a passport that was issued by the Government of Hong Kong Special Administrative Region of
the People’s Republic of China.
An applicant who does not hold a passport or a travel document issued by the country of
citizenship, may submit with their application:
• An identity documents issued outside Canada before the entry of the person to Canada
(provided that the identity document is genuine, identifies the applicant and constitutes credible
evidence of the applicant’s identity); or
• If there is a reasonable and objectively verifiable explanation related to circumstances in the
applicant’s country of nationality or former habitual residence for the applicant’s inability to
obtain any identity documents, a statutory declaration made by the applicant attesting to their
identity, accompanied by:
o (a notarized) statutory declaration attesting to the applicant’s identity made by a person who,
before the applicant’s entry into Canada, knew the applicant, a family member of the applicant,
or the applicant’s father, mother, brother, sister, grandfather or grandmother, or
o a statutory declaration attesting to the applicant’s identity made by an official of an
organization representing national of the applicant’s country of nationality or former habitual
residence.
The statutory declaration must be consistent with information previously provided by yourself to
the department and the Immigration and Refugee Board, and constitute credible evidence of
your identity. If you provide statutory declarations, you must also provide an explanation as to
why you are unable to obtain any identity documents.
The person(s) attesting your identity must provide a valid and legible identity document to
support their statutory declaration."
