Filing a complaint against Canadian Panel Physician

Hello all,

I'm looking for support as to how to go about filing a complaint against a Canadian Panel Physician. I recently had to undergo a medical exam for my permanent residency application. The doctor I saw was a registered panel physician in Ontario. The doctor was incredibly unprofessional and assaulted me. I'm completely clueless as to what I should do: I want to speak out so this doctor doesn't harm anyone else.

I'm currently a US Citizen living in the US. My application for PR is still in progress, but the medical portion has passed.

Are you presently in Canada or back in State? There are many easy way to go about it. First you can search and contact marketplace or Consumer protection of Ontario or better still College of Physicians and Surgeons of Ontario (discipline unit). Though, you have a right to complain a civil wrong to the police. But, the police might need your present or more information to carry out investigation. On a final note, I will say your choice depends on the gravity of assault. Note, however, you don't need to be a citizen or PR to seek police assistance in civil or criminal matters once you are legally admitted to Canada.

On the immigration side, you can contact the relevant RMO to inform them of what happened https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/panel-members-handbook-2013.html#app1.3.

On the criminal side, you can contact the police in the location where it happened. It doesn't matter if you don't have residency in Canada.

Would add that you can also contact the college of physician and surgeons. Unfortunately the tribunals are usually run by peers so physicians rarely get punished unless there is very strong evidence and/or multiple patients complaints. You don’t know if others have complained so would encourage you to contact them. If they work in a practice or hospital you can contact a supervisor. I am sorry for your experience unfortunately I don’t hold out huge hope that the person will lose their license but hurting them financially will be a step in the right direction.

Thank you everyone for your responses. I greatly appreciate the support and information. I plan on filing a report once my permanent residency is solidified. Hopefully others can avoid this experience in the future.

Would be much better the report as soon as possible after the incident because the longer you wait the harder it becomes to prove and the more women can be assaulted. A panel physician can’t cancel your PR unless you actually have an illness that meets excessive demand. Would encourage you not to wait that long. On the other hand I have seen how many doctors are allowed to keep practicing with abuse allegations so unfortunately don’t have huge hopes that your reporting will lead to changes. Hopefully other women have reported too so there is a strong case,

Reporting the complaint will have zero effect on your PR app, so don't wait.

Agreed, do not wait to report the doctor. Not only will it make the complaint more credible, but you can also spare someone else from potential abuse.

Hello Everyone, my parents went for premedical done for super visa and my mother mentioned that her treatment for Hepatitis has been done by other doctor. She sent medical and then it got returned saying that further tests required. Mother went again and 2nd time blood test done and found 1200 count of virus. Liver specialist said 3 month medication required and then this physicain said buy 6 month medication.
We were surprised by test because we been getting blood test done every 6 months after treatment and every time result was not detected. So we went to the previous doctor who treated this Hep C and got blood test done at different lab to make sure and we found that results were saying "virus not found".
We went back to liver specialist recomended by physician and he said no need of medicine if this latest report dont show anything. But physician said this report is wrong and the one shows virus is right, she did not even bother to get blood test done again from different lab. She said report has been submitted and you have to take medicine.
Doctor is in India and I have doubt on doctors report that it was tempered to sell hepatitis medicine.
I am thinking to change physician but not sure if I can ? Any suggestions what else could be done ?

The test shows virus load 1200 unit, that blood sample waas taken at doctors office, then doctor sugested us to visit Gastroenterologist for further diagnosis and all the other tests (indoscopy, ultrasound and fibro scan) were done Gastroenterologist and they were all clear.
The blood test that show "virus not detected" are done by other Gastroenterologist office by a Laal Pathlab. When we showed that recent report to both Gastroenterologist, they recomend us to not take any medicine. But this CIC physician said we have to take 6 month medicine. She also mentioned that the test done in Laal Pathlab is not right.
After all this done, my parents visited another phycian from cic list in same city and he said there is no need of medication after looking Laal pathlab report. Laal Pathlab is reputed lab in India. This new physician recomend us to talk to CIC and change the physician. Parents have already visitor VISA, now they decided to come to canada and get medical done when CIC agree with us to change physician. CIC should allow us to change physician due to this doubtfull situation, also we have right to change physician if you change your location, move to different location.
If Canadian lab cleared HCV test, then I will file complaint against this doctor.

Sounds like a good plan. Hopefully the new panel physician in Canada will show normal test results and will provide proof to IRCC that the panel physician in India is 100% committing fraud. Unfortunately it does seem like the doctor is corrupt. It is one thing to try and make money by ordering more tests but advising people to take medication without grounds could harm someone and is medical malpractice. Would keep your records so you can show IRCC when you file your complaint.
