Hello everyone, i am an asylum seeker since december 2019, i met my boyfriend who is a citizen in january 2020 and we've been living together for a year and one month now, i've still not gotten a date for my hearing but we will like to marry. i'm not letting him sponsor me for PR but instead wait on my hearing, is the marriage still going to affect my case and the possibility of me being accepted?

Why you won't let him sponsor you? Asylum process to PR is a long way and sometimes stressful one. If he wants to sponsor you let him do.

Would be better to get PR based on her/his own path. They essentially met and moved in together right after she/he claimed asylum and met and just crossed the common law time frame. This will cause quite a lot of scrutiny of the relationship. It is not unheard of for asylum seekers getting into a relationship with someone who has PR and citizenship very quickly to try and secure PR. Would add that if they break up have secured PR by yourself if you keep applying for asylum.

Marrying a citizen will not give you any advantage, please be aware of that. The only negative thing that I thought of depends on your background story, as meeting someone/moving in with him/getting married extremely fast might present you in a bad way (like you just wanted to have a plan B if they reject your claim).

BUT if you actually looking for plan B, being in a common law relationship (which you are in automatically after living with him for a year) is almost as being married in Canada. Just make sure that you build a history with him, like rent has to be in both names. Hydro bill too, etc. I would recommend waiting until you get your hearing day before signing the marriage contrac, but it is your personal choice.

I forgot to tell you you can ask him to write a letter to the court about you and the relationship and it can be sent to the court when they give the notice of hearing (consult your lawyer about this). Your partner can write a genuine letter about you and ask the court to help you build a life here. It might help and it might means nothing to them. But it is good to include it in your case file to show that the relationship is real and strong before getting the hearing results.

Hello, I am not an expert but that sounds a little arranged to the eyes of IRCC and IRB, But, I think what you can do is go on and marry him, and update your status to common law or Husband as you wish, then you will drop your refugee's application because you married a citizen, you will need to prove that your relationship is not staged! and it will take sometimes too as they will question you and your spouse, so get a lawyer and explain this to him/her
