Hi,

I was creating an express entry profile and got confused with job offer question that is Do you have a valid job offer? Please suggest you answeres, here is my scenario;
I have post-graduation work permit and it's exempt from LMIA.I have been working for "XYZ" company for 1 year with the job title of Web Developer and it is a permanent position.

Could you please suggest me whether should I Answer it YES or NO. If YES can you please provide me some concrete example or link to follow up?

Thanks in advance for your suggestion.

I feel your pain. I am in a very similar situation. It is so messy and poorly explained on the website:

http://www.cic.gc.ca/english/helpcentre/answer.asp?qnum=1009&top=29

"You should only answer “Yes” to the question “Does [your name] have a job offer in Canada?” if:

  • a Canadian employer (or up to two for the Federal Skilled Trades Program) has offered you a full-time, non-seasonal job for one year or more and
  • that job offer is supported by an LMIA, OR
  • the job is exempt from needing an LMIA.
If you are currently working in Canada but have not been offered a job that is supported by a LMIA (or is exempt from needing one), you should:

Basically says answer "Yes" and "No"? I fall into both categories. "Yes" because "the job is exempt from needing an LMIA." and "No" because I am "currently working in Canada but have not been offered a job that is supported by a LMIA (or is exempt from needing one)".

No, you do not fall into both categories. You do not have a future job offer, therefore, you do not have a valid job offer.

Thanks, but can you explain why?
https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/express-entry/become-candidate/eligibility/offer-employment/lmia-exempt.html

1) Because you are on an open work permit, your employer is not named on the permit, which is a requirement for the "LMIA-exempt" category of valid job offer. So you would need an LMIA-supported job offer to be eligible.

2) You cannot use your current job as a "job offer" which is in the future. Even though your position is classified as "permanent" by your employer, you are on a temporary work permit, therefore your work is temporary. You would need a written offer of FUTURE employment for at least 1 year contingent upon your becoming a permanent resident (along with the LMIA).

Thanks. She does no have enough bank balance. If she borrows it from someone and shows it in her account is that ok? Will it be accepted considering she has a job in Canada. What is the best way of showing and getting though the borrowed money situation.

No. She cannot borrow the money. There's no situation in which borrowed funds would be accepted.

That being said if she receives the funds as a gift instead and gets a gift deed then that would work.

Hello all, I have a question somehow related; I understand that we have to answer "no" to the job offer question but what about the work experience part? I am currently working on a post-graduation work permit and I entered the job as my current job o the system. It asks me if the job requires a "work permit and LMIA". I said "yes" to that but the company doesn't have LMIA for this job. Should I not enter this current job at all?

Hi all, I have a situation similar to this. I am working however in research in the education sector does that mean that I am LMIA exempt under section 3c designated by minister?

What kind of work permit do you hold? PGWP or closed / employer specific? How long have you been working for your employer on this work permit?
