I'm an 28 year Old Indian Citizen working and living in the UAE (Dubai) with my family for the past 13 years (High School & University done here).
I have been working full time for the past 5 years as a Product Development and Sales Engineer in the same company.
I have an IELTS score of 8 (L9, R8.5, W7, S8)
I have a Bachelors in Engineering.
I have applied for a 1 Year Post Degree Diploma in Project Management as that is what my current work entails on a daily basis and this course will help me.
I have shown my fathers funds as well as mine (Close to 200,000 CAD).
My tuition is 18,000 CAD for 1 year and I have estimated an extra 20,000 on top of that as living and miscellaneous costs.
I have an active express entry profile.
My primary intention is to study, but also at the same time get some points for my express entry CRS score.
I thought instead of studying in the UAE I might as well do it in Canada to experience the stay and culture in Canada.
I have mentioned in my Letter of Explanation that I have an Express Entry Profile and my only intention is to study right now and not overstay my visa.
I have good travel history with visits to USA(multiple), Germany, Netherlands, Italy, South Korea(multiple), Hong Kong(multiple), Taiwan(multiple), Malaysia, Thailand, Turkey, Egypt, Kuwait, Bahrain.
Even though I'm from India I have lived only there for 2-3 years continuously. My family has multiple properties there and I have shown this in my application.
I have provided a support letter from my Company CEO that I will join the company again in Dubai after my studies in Canada.
How do I convince the visa officer that I will leave Canada at the end of Stay ? I genuinely do not want to stay there after my studies and that my express entry profile does not affect this in any way ? My plans to immigrate to Canada with PR are something for my future and not something I want to do right away.


I was refused on the following points :

I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR :
1. based on your immigration status.
2. based on your family ties in Canada and in your country of
residence.
3. based on the purpose of your visit.
4. based on your current employment situation.


I have also applied for GCMS notes and got the following (copied as is from notes) :

28 yrs old. single. Indian ctzen.
to study project management post degree diploma at Douglas College from Jan 2021 to dec 2021.
PA has completed Bach degree in Engineering in 2015 and has been following a career as Product Development and Sales Engineer in Dubai.
States his interest in immigrating to CDA as he has active EE profile in progress.
Motivation for this is not convincing even upon review of submissions and letter of support. Cost of studies is rather significant in light of pa's/family financial situation. am not satisfied therefore that pa's ties to home country and country of residence are sufficient to compel pa to leave Canada at the end of authorized stay and that motivation to study is genuine. am not satisfied that pa's career prospects in home country justify pa's stated motivation.am not satisfied that motivation to study is genuine. Refused.

I understand that my EE profile might be affecting their decision but why my financial situation ? I have shown enough funds and have a good steady income.

Yes bro this is the case ur EE thing caused refusal. I have seen the similar case getting refused. Also, What i can suggest here is to apply to a college/uni of New Brunswick. why I said this is they have a program in which EE file who have applied for SP directly gets PR something I don't know what exactly that was but yes it has similarity with ur case. To get detailed idea about this refer a Youtube video of SRNacademy aboutNew Brunswick PNP. Goodluck. It may have bro. As there are many clgs/univ in New Brunswick right? Also, plesse refer that video u will have the whole idea. As, not only u will complete ur studies but u will also get PR(your sole purpose) bro.

Did you explicitly mention in your SOP that you have an active EE profile ? or did you apply for a SP from the same e-mail ID as your EE ? I've never come across any comments where VO has noted about EE profile as there are many who have an active profile & have got their SP without any problems.

No socio economic status back home. Ties cannot be created or adjusted, it is what it is. If you have decent ties back home then rebut it in your next attempt.

Seems VOs have begin to target guys in their late 20s as well, there is a long gap between your graduation date, anything exceeding 5 years is risky.

Douglas almost comes under the mill league.

I used the same GC Key account to submit the SP application, and it was mentioned in my SOP too as i wanted to be transparent about it. I said that even though i have an active EE profile i would still leave Canada at the end of my studies.

I have no economic ties back home, only familial ties i have are my aunts/uncles. My parents and sibling are in the UAE and they are my ties to my country of residence. If they by any chance move to India within the 1 year I'm in Canada then i would still come back to the UAE as i will still have my Job here.

I'm not sure how i would convince them that i genuinely will leave Canada after my studies.

It's still possible to fix the economic status by making your family shift back to India but it maybe counterproductive now since its now recorded on the GCMS history, if you wish to go down this way in the future the family shift should be pre existing for at least a year or more to convince the VO.

Applying from your home country will fix the immigration status issue.

For employment situation/purpose of visit, VO is not satisfied regarding the progression and study plan, needs detailed LOE explaining the prospects viz.

For EE issue, present a separate dual intent letter.

Understand your reasoning. But honestly, this won't help your case. VO have anyways been unreasonably declining VISA's mostly for people residing in GCC countries. You are being honest(which is good) but trust me no matter what you write, they feel that all people living in GCC countries are fraudsters who will illegally stay back in Canada. So the story needs to be more convincing than ever for you to have a chance. Anyways, wish you the best for your re-application. Ensure you do proper research and then apply with a fresh SOP.

I don't think moving my entire family back to India for my SP is possible haha.
And if i do apply from home country, my family will still be in the UAE. So I'm not sure how they will count my ties to Home Country then.
I think i will try something for the Dual Intent letter, as i'm aware of a few expats that applied from the UAE with EE profile and still got approved in their first try.

It's not about your SOP. It would be very obvious to the visa officer that you're just trying to get points for Express Entry, and education is not your purpose at all. So without a genuine purpose of study, your permit will be refused immediately. Of course some do manage to get through the cracks by lying on the applications, that's why nowadays it's becoming so strict because the visa officer can see that your profile is very irregular. Blame your own countrymen in the past that try to deceive and manipulate their application to the visa officers to get entry into Canada without having intention to study.

From the notes, your finance seems okay to the VO. However, the VO was more concerned about your ties to either your home country or CoR and MAYBE your letter.

Since you and your family are economically well-established and still have a valid status in Dubai, in your reapplication, included government tax certificate/documents, financial records, employment letters for you & father, copy of residence permit et al.

From my observation, applicants who are expatriate applying from UAE are always stressed out before finally getting the approval green light. In conclusion, you will be needing a good SOP and/or LOE.
