You've misunderstood my post.

My guess is that as part of the spousal sponsorship application and to show the relationship is real, they included a period of cohabitation that lasted at least a year and pre-dated the sponsor becoming a PR.

So they may have called themselves out by saying there were in a relationship and common law before he got PR.

Oh I get it now....yes, costly mistake.
 
When he started the application we weren’t common law.. he lived elsewhere and moved in with me ( we have verification of address to prove this) we only became common law during the process And at the end of it he failed to add me. Also our baby was born after the fact so technically I’m the only one in trouble but my baby can be sponsored

At or before landing he should have added you.

Unfortunately this doesn't change anything. It was mandatory that he add you to his application once you became common law and before he landed in Canada and became a PR.

Your best bet at this point is to explore the economic immigration programs such as Express Entry and to qualify to immigrate on your own.

okay thank you all for the input . There are a few more details to our situation So we decided to appeal, I don’t know how it will turn out but will update you all. Trying to muster some strength after this disheartening news.

Hello Guys,

I really need some help to shed some light to my situation. I just got a mail from the IRCC that I am ineligible to sponsor my wife and my son and they automatically withdrawn my application without reaching out to me. This is what the letter states

"You have not submitted an application for a member of the family class. You did not declare the applicant to IRCC on your own Application for Permanent Residence or at the time you became permanent resident of Canada. As such you do not meet regulation 117(9)(d)."

I actually cannot understand why I got denied. Because I am 100% sure that I declared them when I got sponsored by my mom.

It seems to me that you did not complete some the sponsorship forms properly or accurately, I recommend you submit a completed package based on the IRCC website and make sure all the docs and files done completely. If your mom is co-signer then it could undermine the whole process since it disqualifies you as the sponsor. Hope all works, good luck.
