Hi @legalfalcon
Query Reg Ref letter

My last employer HR refused to issue Ref Letter.
But one of senior colleague in that last company agreed to issue me Ref letter on company letter head and will attach his employee card along with letter head.

Will this Ref letter by senior colleague on letter head be accepted by IRCC?
(means both refusal from HR and ref letter would be attached during document submission)
YEs it will be accepted. However, you will have to include other documents too to substantiate your case such as an offer letter, promote / incident letter, IT returns, pay stubs etc.

Also, explain it in LoE that your company refused to provide you with a reference letter.

Hi @legalfalcon sorry for coming back with same question. Regarding OPT visa. The decision from USCIS was "your application for employment authorization is denied since you filed your form on date 1 whereas the designated school updated a recommendation on later date"

Does this count as refusal for "Statutory Questions"
"Have you been refused refugee status or an immigrant or permanent resident Visa or visitor or temporary resident visa, to Canada or any other country".
Thanks!!
OPT is not a visa as such, it is a status along with your F1 visa which allows you to work in the US while on the F1. So you should answer yes, and a prior visa rejection has no bearing on your current application as long as it was not due to immigration fraud or criminality.

Hi @legalfalcon Now I am a bit confused.
If OPT is a status along with F1 Visa then should'nt the answer to the question be "no" ?
Sorry getting confused.

Hi @legalfalcon @caipsnotes Once we receive CoPR email and have a situation where passport was recently updated (as it was expiring), do I need to inform IRCC? I am not sure if they will do anything with the web form request given that file is approved.
Also I'm CEC Inland applicant and planning to go out of Canada. If I want to apply for PRTD, do I have to send my both old and new passports if I do not inform IRCC about the passport upgrade? Please clarify.

If you just got your medicals done on 16 December may not have been updated. Just send the upfront medical sheet for the exam done on December 16 and send it to IRCC in response to the remed request.

You do not need to get another medical done.
Thanks @legalfalcon for your help.

How do I send the upfront Medical exam (Done on 16 Dec 2020) in response to the remed request?

I mean is there an other way to send them as I had sent them via webform upload. (16th Dec 2020 & 2nd Jan)

If I am supposed to send them again via Webform, what different subject should I use now? And should I include the Remedical request document along e medical?

Again many thanks for helping new immigrants like me

At this point you only need to see a copy of the new passport when applying for the PRTD

See

Important information:

You must send your original, valid passport. We need this to attach your Permanent Resident Travel Document.

Send photocopies of all other identity and immigration documents. Do not send originals, as they will not be returned to you. See the document checklist for more details.

From an interesting tweet

Due to a technical mistake by the parents their child's application was denied. IRCC gave them a Voluntary Departure stating that the child wanted to leave Canada. The child is seven.

Hello @legalfalcon .

Firstly I thank you for your help and insights to all our fellow immigrants here.

I require your help with my case.

I'm AOR 16th December 2019.

Actually my medicals expired in Dec 2020. So I decided to call up IRCC and was informed by an Agent that my medicals have been extended upto April 30th 2021.

However when the same wasn't reflected in my account, my Agent asked me to go for another upfront medical exam. I did that on 16th December 2020 & submitted the same by uploading e Medical information sheet but didn't get any response from IRCC.

However today I got a message in my account asking for a Remedical Request.

Now I am confused that if I should go for the medical again (For the 3rd Time)?

Or if the medicals which I did around 20 days back would be updated in the system.

My GCMS notes say Ready for Approval since 25th May 2020 and no action thereafter.

I would highly appreciate your help with this.
That's amazing you got MR because no outland applicants got any MR.

Please keep update your process time to time.

Thanks

You do not have to use a different subject. Even if you do, all documents sent to IRCC are named as per their own format.

When you send the webform, you an can mention that you had already done the remed. before the request from IRCC was sent and the upfront medical was sent xx date.

If you renew your passport before your receive the COPR, you should send the scan of the biographical pages to IRCC via webform. Your passport number is entered on your COPR. Although, if you get a new passport and you have already received the COPR, you do not have to worry, as all valid documents and visas remain valid that may have been on your old passport or have the old passport info.

Also, your previous passport info is entered in your current passport on the last pages or is electronically stored on your passport.

Your COPR will have your passport number and country of issuance.

If you apply for PRTD, you will have to check whether you have to send both passports or just the new one. It will depend on the country where you apply for PRTD.

Eg. If you apply for PRTD in India then you will have to submit the following:

Where to submit your application for a permanent resident travel document

India
Change country or territory

When you submit your application, you also need to submit:
  • the original travel passport
  • good quality photocopies (minimum 300 dpi) from your current and previous passports for the last 5 years, including
    • all pages with visas
    • all pages with stamps
    • all pages with your biographical data (name, date of birth, passport number), including your photo

Hi @legalfalcon Now I am a bit confused.
If OPT is a status along with F1 Visa then should'nt the answer to the question be "no" ?
Sorry getting confused.
There is no confusion. OPT is merely a change of status of your current visa. On F1 you are not allowed to work for more than specific numbers of hours. Where as on OPT you can work full time in the field of your education.

Any application filed with USCIS, for a change of status of your current visa, is a visa application and should be disclosed.

We can keep deliberating whether a change of status is a visa or not, but if your application was refused by USCIS, then better disclose it.

Thanks for the reply. I had confusion of whether I should give 'yes' or 'no' for the questions. Now I am going to answer 'yes' and explain in detail.
