Hello experts,

I was invited by CIC last week to submit the PGP application. My intention was to apply for my step-mother who has visited Canada on visit visa a few times in the past. My father is deceased (2012). He married my step-mom in 2003 after my biological mother passed away.

I am reading in forums here that I cannot apply for my step-mother under PGP if my father is deceased.

Is this correct? Is there any other way I can apply for her immigration under PGP? I have been submitting the intent for 3 years and finally got it but it seems the effort will go to waste as they will not accept the application.

Unless she legally adopted you, I don't think you can sponsor her. Others who have more experience can hopefully give you a firmer asnwer.

No you can't. You can only sponsor parents related by blood or adoption.
This is clearly outlined on IRCC website.

Thanks for the reply. Just so I close the loop here: Even if both my parents are deceased and my step-mother is all alone? Just don't want to give up on this.

You can always submit an application to try.

But yeah pretty likely to be rejected. But no harm trying really. You already won a spot in the lottery. Why waste it?

So I assume that when you submitted your interest to sponsor back in October 2020, your father was alive and since then your father has passed away. Otherwise you took a spot that you are not qualified in the first place. There is no loophole you can use to sponsor your step-mother,
Honestly, I didn't even realize this would be an issue. I just thought its a straight forward process. Should have looked at this more closely. Feel bad for taking that spot.

But yeah pretty likely to be rejected. But no harm trying really. You already won a spot in the lottery. Why waste it?
He will lose the application fee once they open the file and notice he does not qualify to sponsor, So sure he can waste his money on it. But I am sure he doesn't want to waste the money.

Why not apply with a letter of explanation and see what the outcome is. Your case is not common maybe IRCC will be compassionate. Who knows?

IRCC should refund the application fee if they reject him/her.

It will be the Canadian thing to do.
They will only return the "right to PR fee" $500 only. Once they open the file, the application fee is considered a final transaction.

They shouldn't refund. Because the application has started and that fee only really covered very small part of the actual cost of processing any application.

They should put the fee into a pool. And then for next PGP lotteries also include cash prizes for winners paying out from the pool of application fees from people who didn't qualify.

I am just kidding and being creative with the whole lottery thing. LOL!

Despite you just kidding,, why would they want to do that. All the more to put more money in their pocket, not yours.
