PGWP rejection because of 20+ hours of work

Bongoman is correct - they don’t immediately have access but if they suspect that there may be something amiss they will request access and check - that’s mostly how people get caught. The lawyer I spoke to said the exact same thing. I submitted an LOE admitting to the misrepresentation and then requested a TRP so I could overcome that admissibility so it wouldn’t affect any future applications where I might have to submit those payslips and the like.

I have a similar situation, I went over probably twice, but my pay stub is bi-weekly, so according to the pay stub, I only worked 40 hrs for 2 weeks, but I don't know if it works since I think IRCC does have access to CRA. And also, one time, the employer mistook my pay stub, I only worked 39.5 hours for 2 weeks, but my pay stub showed I worked 43 hrs for those 2 weeks.

They cant check every rule. Try and find anyone who has been rejected for working extra hours, either they admitted it in the application form or they were caught while working, like the recent famous case. Ircc has no way of checking automatically, that is why for some immigration applications you have to submit your own proof of work docs, they don't have access, period! If they had access why do you need to submit payslips for spouse work permit? Why do you need to submit proof of employment for PR application? Simple they dont have this info.
I kinda think they have access, but I haven't found anyone who got caught and got rejected for pgwp for extra working hours. But I think it could be possible, I know that employers need to report our payroll regularly to CRA.

Immigration cant access CRA records on a normal day to day basis.

So when I apply for PGWP or PR, just hide it, never mention it right? I am getting paid bi-weekly, I happen to exceed 20 hours twice, or three times. but on my pay stub, I worked 40 hours 2 weeks. Just one time, my manager mistook my pay stub, he gave me extra hours that I did not even work, which led to exceed 40 hours 2 weeks.
I am kinda worried about it too, cause I think they must have a way to check it, since CRA and CIC do share information according to the government, but I don't know how much information they are gonna share, or to what extend CIC can check your CRA records.

Remember this : Whenever you hide or misrepresent anything on your immigration documents, EVEN if you may not get caught immediately, you are leaving a hole in your situation. IF (and it has happened in past), IRCC goes back and audits its past application then they may find folks who have lied in the past leading to action on such folks.

hi! I'm actually still waiting to hear right now! I believe my application is being processed currently! I did speak to a lawyer though who said it shouldn't be a huge problem as long as I submitted a LOE which is what I did! She said that if I did that, and still got rejected it would be because of a very nasty officer! Hope that helps, and I'll update when I get my answer!

When did you apply?

hey did you get your PGWp? i have two hours extra in a weeek and couple of extra minutes over seven week.

I made a request that I was overpaid, so my employer corrected after I paid back the money, it should be fine for me, just 6 hours, I haven’t graduated

Do my employer only need to claim that i got overpaid or also your schedule needs to be adjusted to show only 20 hours?

Your concern isn't being overpaid, it's the hours. You could still get paid 2000/hr for 20 hrs and get PGWP

indeed. i have nine week exceeding by couple of minutes the 20 hours per week ,and one week i have 22 hours which genuinely thought i was working 20 hours, and if i exceed my shift by 10 or five minutes it wont be taken into consideration.

how can i adjust this? also, what are the consequence when applying for pr
