RO not fulfilled, PR card expiring next year... any option?

Hi,
I know my case is almost over but just for curiosity I am wondering if there is still any chance left to get back to Canada. Me and my family landed to Canada as a PR in May 2016. However, we did landing formalities and left Canada after a week.

Then I got a job in KSA for couple of years from 2016-2018. I wanted to go back to Canada in 2019 but my mother got seriously ill and paralyzed. I left my job in KSA and came to Pakistan to look after her. She passed away in February 2020. and after that this Covid-19 thing arrived, so I was unable to travel throughout.

I am wondering if there is still any chance to get back to Canada, although PR card is still valid until May 2021 but due to not meeting RO,I am expecting strict interrogation from Immigration officers and ultimately denial of entry which may impact my whole family.

So should I give it a try or give up?

If your card is still valid until May 2021 then enter Canada in the next few months and move here to meet RO. You could have travelled here during Covid so that isn’t an excuse. You would not have strict interrogation if your card is still valid.

I would say give it a try. No harm trying to enter, if you dont get reported, you have your PR back in good standing as long as you stay for 2 years after entering.

Would also suggest trying to move to Canada but you will need to bring proof of your mother's illness along with proof there were no other family members in Pakistan who could have cared for her. If you weren't reported you'll need to remain in Canada for at least 2 years without leaving. Would add that many have travelled since this summer from Pakistan. The earlier you return the better since you are pretty close to the 5 years from your initial landing date.

My case is a bit tricky as my wife never got PR card but has COPR so I have to apply for her PRTD.

Also my daughter was born after we got PR so obviously she has not PR status but she is British citizen and can travel to Canada visa free as a visitor for 6 months.

So even I enter Canada along with my family as a PR but my daughter will remain as a visitor.

Do you think I will have to wait for 2 years to apply for her PR application? Untill I get my PR renewal?

Your wife will also need to apply for PRTD by H&C which tends to be harder than getting approved at the border. You not only have to show that your mother was sick during that period you need to show that there were no other family members in Pakistan able to care for her so you had to remain in Pakistan.

Thanks for your detailed response, my two sisters are in Canada and Canadian citizens and one in USA. But under these complex circumstances of my family, I think there is no point of going back to Canada and should give up.

Yes you are right. Even I managed to get in. My daughter being a visitor will not be able to get access to education and healthcare. I was on Alberta PNP.

Yes, or H&C considerations / reasons for being out of compliance with the RO.

Note, I'm unclear on specifics of your wife's case, like whether she landed in Canada at all, it certainly seems she had little time in Canada so demonstrating may be very difficult.

Yes, for the PRTD to be approved, you must meet the residency obligation. Your wife would need to apply for the PRTD under H&C and state the H&C reasons why she has failed to meet the residency requirement. I would apply soon since processing can take some time. Good luck.

You should tell us whether she landed in Canada, because it will be a bit more complicated if she didn't, because your permanent resident status only vests when you successfully complete your landing in Canada.

If she hasn't, her COPR has lapsed and you would most likely need to sponsor her for PR again. I don't see the embassy issuing her a PRTD if her COPR and potentially PR visa has expired.

That's why i think you'd be better off trying to enter Canada yourself to begin with, then try to sort out your wife's status after that.

My wife landed with me in May 2016 and she was pragnent at that. I was working in the UK and was on 1 week off. So she actually spent 1 week in Canada with me. Got her SIN and we came back to UK because of my job commitment. So her PR status is also expiring in May 2021 alongwith me. But hasnt got PR card as she never received it.

We wanted to go back to Canada after some time but I got a lucrative job offer from KSA for 2 years contract so we went there for couple of years with a view to go back to Canada after 2 years of my contract.

However, as soon as I completed my contract, my mother was hospilized with serious condition so we came back to Pakistan to look after her as She had an arthritis and couldnt do anything on her own. I looked after her for year and a half untill she passed away in February this year.
Then whole scenario changed because of Covid-19 and it was too late already as I almost spent 3.6 yrs outside Canada.

To be honest I already missed my last chance going back to Canada in May 2019 in order to spend my last 2 years of PR in the Canada and fix my RO.

All in all I believe its too hard now to make an attempt specially due to the situation of my wife PRTD and my daughter who was born after acquiring our PR status.
