Friends... While filling the questionnaire for applying BOWP in my IRCC profile. They ask if my PR application is approved in principle. My AOR is 2r and no action is taken on my application. If I select no for this question, the system tells me to apply WP extension but if I select yes, the system tells me to apply BOWP. So I am confused here. Please advise. Thanks

When I applied, i answered yes, approved in principle, even though, I had only gotten my AOR at that time. I completed a paper based application, because after doing the questionnaire I was led to the list of documents required, which had documents I had never heard of. So I called IRCC and was told I had to do the paperbase application. If you are unsure, you can call them as well. Hope that helps

1. Apply for Work Permit with Same Employer

3. Restore my status as a worker
4.Get a New TRV

I think it will be option 1 if you will continue to work for the same employer. In my case, I am applying BOWP with the same employer and I have been asked to select option 1 by my immigration team.

This is the criteria for BOWP according to IRCC:

"To be eligible, you must:

  • live in Canada (Quebec not included)
  • have a valid work permit that expires in 4 months or less
  • be the principal applicant on your permanent residence application
  • have submitted a complete application for permanent residence and passed the completeness check
  • have your acknowledgement of receipt letter
    • we send this letter to your account after we get your permanent residence application."

What makes your think you are not eligible?
if you are in Canada, have a valid work permit and you are the principal applicant of your PR application and have received the AOR, you are eligible.

Where did you get this from?:
"I was hoping to apply for a BOWP but it seems impossible since my current work permit expires in less than a month." --> FALSE
How do we get to know whether we have passed the completeness check? I'm looking for this answer from day one but I have never figured it out. On the IRCC website they have mentioned details of GCMS but there is also a catch to know when GCMS sets the status to 'Ok'.
Can we just apply based on Acknowledgement of Receipt?

It would be a big help if you can help me with my queries. Thank you!

Acknowledgedment of receipt is exactly that. Completeness check is simply that they have assessed that you have submitted a full application, no documents are missing. If your application were to be missing something you would not receive an AOR.

To apply to BOWP you need to submit your AOR letter as part of your application.

You must do this before your current WP has expired. If it has already expired you are not eligible and will have to leave the country.

Thank you so much for clearing my doubt regarding the completeness check!
However, I just have one-year WP and in that case, I can only apply for PR through CEC after completing one-year of Canadian experience. Considering all the circumstances, I would get an ITA after my WP gets expired and I would be on a visitor visa. So, can I apply for BOWP through Visitor Visa?

NO.

You need to have submitted a full application while holding a still valid Work Permit. If you won't be able to do this, then you will not qualify for a BOWP. You need a valid soon to expire work visa (PGWP) to be eligible to apply.

Since PR applications can take even over a year to be processed, though hopefully will not be the case, you will need to leave Canada and come back once your application is approved.
