hello,

hope you're doing well.

just have a couple of questions about the job offer. I have a Spousal OWP and worked with the same employer for one year in a NOC B job. they accepted to help me with my application giving me the job offer. as my current WP is categorized under C42 LMIA exemption, can the employer submit an LMIA for me although I am exempt from having one?

the second question is that even with making changes in my work history in my EE profile, as I am LMIA exempt, I can't answer YES to the following questions:

  • Was a positive Labour Market Impact Assessment (LMIA) issued for the job offer in Canada? (required)
  • Was a positive Labour Market Impact Assessment (LMIA) issued for the current work permit? (required)

for the latter, I can't choose any of the ones having a NO answer with a description as well so the points were not applied.

can someone please advise?

Yes, your employer can submit an LMIA application for you.

You need to answer no to both of the questions above. You won't qualify to claim the 50 points until your employer has obtained the approved LMIA. Right now you don't qualify for the points.

another question that popped u to my mind is that my NOC is not a demanding one in my current province of residence. I am currently residing in Ontario and my NOC code is 2282. do you think I can get that LMIA for that? will I be approved?

I don't know. Your employer can certainly try.

currently I am on PGWP.
If you are on a PGWP which is an open work permit, a job offer doesn’t give you 50 points. Your employer if he want to support your PR needs a positive LMIA.
