I have a question

How do i respond to "Do you have a valid job offer"?

I am on an employer specific work permit (my current employer are named on my work permit), i have a full time contract with them, and i have worked for them for 2 years.

Can i say i have a valid job offer? I do not have a letter from my employer stating they will offer me a 1 year contract after obtaining PR. But i have a full time contract with them.

Assuming you have an LMIA or are LMIA-exempt then you do need the letter to claim the points.

I’m currently based in Canada with an ITA and CRS of 481, and in a dilemma to accept my ITA or not. My confusion is regarding the “Do you have a valid job offer” question.

I am on my PGWP currently which is expiring on 3rd October, I have applied for a new work permit recently based on LMIA valid till February 2021. I got the ITA under CEC. While submitting my Express Entry profile, I answered the “Do you have a valid Job offer” question as “Yes”. There were LMIA related questions which I answered as No. I didn't get any extra 50 points for this valid job offer question. I assumed this was the correct answer based on my work permit.

Please note: My CRS score does not change(as I didn't get any additional point for this in the first place), I have tested my CRS score based on my answers

I am confused about how to proceed with my application:

- Should I accept my ITA?
If yes, Do I answer “Yes” or “No” to the “Do you have a valid” job offer question?
If yes, What letters do I provide?
If no, How will it impact my application, as there will be a discrepancy in my EE and PR application?

- Should I decline my ITA?
What are the chances of receiving an ITA in the nearest draw, My CRS is 481

In most of the previous replies, I read that I can say No in my PR application and then attach LOE somewhere explaining that it was an honest mistake and my score isn't affected by changing this?
My question is does this reply still hold and where exactly I should attach this LOE?

Or it's better to just Decline the ITA and apply again as there are high chances of getting an ITA again in the next round as my score is 481?

If your score is already at 481 without points for a job offer you can go ahead and apply without one. You can include a LOE if you like, but changing something between your profile and your application is normal and not a problem if it doesn't drop you below the cutoff score or MEC. If you wanted to be overly safe you could decline this ITA and wait for the next round, but I really don't think it's a big deal.

Generally, if you change your answer after receiving an ITA and it does not effect your score negatively, there is no impact.

To your question -

Answer what is the truth - which is No, judging by the information you provided.

Very high, 481 is a good score as it is.

After accepting ITA, there's a section where you can upload an LOE.

"As per the Express Entry Ministerial Instructions, candidates are encouraged to decline an ITA if their change in circumstance negatively impacts their eligibility such that they no longer meet the MEC of the federal immigration program to which they were invited to apply, or if their recalculated CRS score falls below the lowest ranked candidate in their round of invitations"

So, you should be fine, but given your score, you can easily decline and wait for next draw.

Just to clarify: If I decline this ITA then the next round of invitation will be issued around 30 September or the 1st week of October. And my current work visa expires on 3rd October and the new work visa is under Process(Implied Status) so will it be safe to apply for PR in October when my current work visa whose details I have filled in the application process will be expired. Will it be fine to apply for PR under an implied work visa?

Thanks a lot for your response! I am going with the option of uploading the LOE stating the fact that my score is not impacted.
For declining an ITA, I was confused because my work visa is expiring soon(3rd October) and then I will be on Implied status(already applied for the new work visa which is LMIA based). And all these changes might impact my PR process so that's why I thought of just attaching the LOE instead with the current invitation.

Hi everyone,


When it is mentioned, regarding the claiming of the 50 points of the valid job offer for express entry, that :

• have one year of full-time work experience (or an equal amount of part-time work) for that employer

in my case i have been working 1 year for an employer as a postdoc (noc 4011)
then, got a new work permit for change of conditions with the SAME employer but now as Professor (same noc 4011)

does in my case the sentence above is correct in my case scenario? as i have been working 1 year with same employer, it is just that this new job offer from what i will be claiming the 50 points have a new name and different salary -but same NOC and same employer. (all LMIA exempt)

(it is like in the job offer letter, the employer will say that XXX has been working for a full year with us as. a postdoc and starting from september 2021 XXX started working as a professor.
the new job is permanent and not seasonnal and is also offered after one year of her getting the PR....)
