Express Entry VERSUS Spousal PR

Recently got married. My partner is based in India. Have a general immigration question. Please see below
She is also eligible for FSW-Outland (480 points) and in addition to Spousal PR outland.
Can anyone please advise which path is quicker? weighing pro and cons of both options.

FSW is quicker than sponsorship. What is ur current status in Canada? Are you a PR already?

Yes, i am PR there for over 4 years and Citizenship application in early stages. Thanks much for replying!

If you are a PR already and she has not received an ITA, then I do not think she can opt for the FSW option anymore. FSW was possible if you were getting married and applying for PR for both together. Please check on the forum for more details on this.

She is certainly eligible. She would apply as the primary applicant. Being married to a Canadian does not stop her from applying for EE/FSW on her own.

She can certainly apply for FSW / EE as the primary applicant.

Make sure she isn't claiming any points for you (i.e. your education, language score, etc.).

In terms of points, She is going to claim me as relative ( 5 points) and me as Spouse ( 5points). Is that OK?
Other than that she is the primary applicant and only applicant on the file.

Are you referring to CRS points or FSW points?

She can't claim any CRS points for having you as a spouse. She has to qualify entirely on her own with no points from you at all.

I thought if my brother can gain additional points on CRS because I'm Canadian, my newly married spouse would also qualify for additional points...I am i completely wrong?

Yes - you are wrong. The extra points are only for siblings. Unless your wife has a brother or sister who is Canadian, no points.

Yes - good chance provided she has actually calculated her points correctly. Given you thought she could claim five points for you when she cannot, you may want to double check all of the points she is claiming.
