Hi LegalFalcon,

I have a question related to travel after dependent open work permit approval.

Once dependent got open work permit approved and stamped, is there any such limitation as she has to enter Canada and get open work permit at port of entry with in X days ?

Or she can travel anytime in future given Primary applicant is staying in Canada ?

Thanks
There is no specific time within which you have to get the permit at the Port of Entry, however the validity of the OWP will not be more than your WP.

See https://www.canada.ca/en/immigration-refugees-citizenship/services/work-canada/permit/temporary/prepare-arrival.html

Hello legalfalcon
How long it takes to complete background check after completing biometrics or status only change once application get finalized. Thanks
The BGC comprises of criminality and security. The criminality is usually done early in the processing of your application along with R10 unless your biometrics is pending or a PCC is pending. To read on stages of an application see https://bit.ly/3jllWCg

The security usually is initiated after eligibility is passed and is the last stage, and for most it takes 3-5 weeks. However, if an applicant is stuck in enhanced security screening it can take a very long time.

To read on security and the security screening manual see https://bit.ly/2HduZIL

One way to keep a check is that your BGC status in your MyCIC account will change twice to in progress. This is an indication that first the criminality was in progress, and then the security.

1. Your become a PR when you receive the COPR and it is activated, usually stamped. See the date on cOPR. PR card is just a travel document that you need to enter Canada and is your proof of PR status.

2. After your become a PR, you can work anywhere, for any employer.

3. Yes.
Thanks for your reply.
For the 1st answer, due to Covid-19 they just issue CoPR letter (the information letter) and Ecas just shows the landing date. What you mean by stamped CoPR? Sorry if this sounds foolish but I didn't get it rightly.

For the 2nd answer, after you become a PR, I can work anywhere in the nominated province? (I was approved through PNP based program)

Earlier there were two stages of becoming a PR when you received the COPR. For outland applicants they had to land in Canada at a port of entry where the COPR would be stamped and effective that day they would become a PR. For inland applicants they received a COPR and then had to either take an appointment at an inland IRCC office or visit the border to get it stamped / activated.

However, due to COVID for inland applicants this process changed and earlier they would get a COPR, followed by a phone interview, which would be akin to admitting the applicant.

Now they have done away with everything for inland applicants, and just send the COPR and as on the day you receive it, you are a PR.

As regards work, you can work for any employer. However, if you were a PNP nominated applicant, then you have some provincial residency requirements. To read on the requirements and your mobility rights under the constitution, see https://bit.ly/3jjqp8J

Hope this helps!

Hi @legalfalcon,
I need your advice. In the express entry profile, I mentioned my spouse's bachelor's degree under her education section and said no for the ECA question, so I did not claim points for her education. Now at the post ITA stage, the document checklist is mandating spouse's education documents, which I have no problem providing as I have her degree certificates, but no ECA. I worry that there is a chance of misunderstanding and that they might expect an ECA. Is it understood that ECA is not required in this case since I did not claim any points? Should I include LOE?

If you are not claiming points you do not need a ECA.

If you go with scenario a, your chances will be better. Not that you cannot get one with scenario b, but if you compare, a will surely have a higher success rate.
Thank you so much Sir for your reply @legalfalcon

Can you please suggest me the bellows:-

1.) May I apply for my Parents Visit Visa right after spending 1.5-2 months in Canada after landing?

2.) As they don't have any travel history, do you think it can make their case weak to get a visit visa of Canada? & if yes, is there any way they can cover it up?

3.) Usually for a PR, what would you say the chance is to get a parents visit visa approved?

I will really appreciate to have your valuable feedback on the above. thank you so much.

I have received GCMS notes last night and notes -2 which is dated in May says ready for approval, while notes-1 dated in August says passport renewal doc received and nothing much. I have renewed passport in July and sent them via a webform and now I see Infosharing is pending, Is info sharing still pending because of passport renewal? I applied GCMS on Sept 21 and received on OCT 21

1. You can apply for your parents visa as soon as you become a PR. However, if you are considering applying for a supervisa, which would allow your parents to stay for 2 years in a row, you will have to show proof of financial support by showing salary or self employment income. https://www.canada.ca/en/immigration-refugees-citizenship/services/visit-canada/parent-grandparent-super-visa/about.html

2. You do not need a travel history. All you need is to show that your are a legitimate visitor who will visit Canada and leave by the end of the duration.

3. If you apply for a super visa and meet the requirements, it is very easy. The approval rate of super visa is very high.
