Hi everyone,

I’d like to seek some advice. I am currently a temporary worker with an open work permit that expires next month. My current employers have given me a full time job offer as I am currently under a 6 month contract.

I am wary of bringing up LMIA as I have heard it’s not so straightforward but at the same time, I do want to maintain my legal status here in Canada. Are there situations where I can be exempt from LMIA ? and if not, how should I approach my employer with them helping me With an LMIA. Any help would be much appreciated

There are situations where you could be exempt from needing an LMIA to continue working in Canada. Have you already been selected through the Express Entry program (received ITA) and submitted your application? Or have you received a PNP Nomination? Those would be two examples. If you have a spouse here on a closed work permit or study permit or PGWP, that could also allow you to extend without an LMIA.

If you aren't aware of any scenario that would make you LMIA exempt, then your employer does need to go down the LMIA path. This does take quite a bit of work and time. Your employer should start now. Details for the process are below:

You should simply ask them if they are willing to go through the LMIA process so that you can extend your work permit and continue working in Canada.
