There is no point in applying until she gets PGWP and a job in NOC, 0, A or B. There is no approval if less than 6 months left of studies.

Hi there,

My name is Simran. I had applied for my spouse’s SOWP and today we received a refusal letter under R205(c)(ii) stating that I’m not a student in a DLI approved college.
I am studying in Conestoga College. This is my second course here and I provided all my documents such as:
1. Enrolment letter (which clearly states Conestoga’s DLI no. and my name & other details on it). Ideally this should have been sufficient.
2. Transcripts from previous course.
3. Fee receipts for first sem of second course.
4. LOA
I don’t understand on what grounds they rejected the application under this clause even when the documents submitted are sufficient. It is completely vague and absurd. Can someone please help? Anyone who faced a similar issue and reapplied and got their visa in second attempt can help me by telling what did they do next. I would highly appreciate. Thanks!

My husband got his refusal last month. I was accepted to Fleming College Toronto for Business Diploma in May 2023. I paid my first semester tuition fee and applied for my study permit. I was approved in September 2023. Due to time constraints, I deferred my start date to January 2024 and subsequently submitted my husband's Spousal Open Work Permit in same September. I included my new Letter of Acceptance, Tuition Fee Receipts and Study Visa Approval Letter and Visa Sticker (passport). I also included our marriage certificate and children's Birth certificates and family pictures to show proof of relationship.

However, he was still refused under
You do not qualify under the IMP as you provided insufficient information to demonstrate that your spouse is a full-time student in a qualifying program at a DLI in Canada. Refused under R205(c)(ii).

Please, your case seems to be since April 2023, have you sorted it? If Yes. I would really appreciate your guidance. Thanks

Did you include proof of new LOA and proof of payment for program starting in January 2024? Even if that is solved spouses of international students aren’t guaranteed. People miss that it says that they MAY be able to accompany their spouses and get an OWP. It tends to be more difficult to join a spouse when they aren’t studying an advanced degree. It also can be more difficult if recently married eeepfiwllt if married after the spouse got approved for the study permit. If you submitted the proof of acceptance for January 2024 and had proof of payment for tuition then I would ask for reconsideration and highlight that you had provided the documents in your application. I would also apply for GCMS notes because there may be other reasons for denial not stated. Sometimes IRCC doesn’t check off all the reasons for denial. You will likely not receive a reply by mid to late December. How long have you been married? How many children do you have and do you wan them to come to Canada? Do they have TRVs and study permits if 4 years old or older?

Thanks for your response. I definitely attached the new LOA and Tuition Fee Receipt. Moreover, we have been married traditionally and living together for over 6 years - albeit we had our court wedding December 2022 (11 months ago). We have three children aged 6, 4 and 2 who were also secondary applicants and were also refused few days after my husband's refusal with the visa officer stating that they did not believe that they will leave Canada after their Studies. In addition, we submitted family pictures spanning a few years.
