Recieved AIP letter 5min later Procedural Fairness letter

Hi all... My husband applied to sponsor me August of last year today I recieved AIP letter and Procedural Fairness letter, I dont understand why they would send the AIP if they needed more information. They are requesting medicals for my son who lives with my ex husband in nyc my ex wont take him for his medical exam and i explained the situation through email my 3 other kids are with me and had there medicals done but my oldest son wanted to be with his father. I dont know what to do at this point.

The AIP is for the sponsorship - confirmation that your husband is qualified to sponsor you. After that, the applicants themselves are examined which triggered the medical request.
Medicals are required for all family members, accompanying or not, as you know. The processing manual gives the following exceptions:
All family members, whether accompanying the principal applicant or not, are required to be
examined unless an officer decides otherwise. Normally, an inadmissible family member, whether
accompanying or not, would render the principal applicant inadmissible. There are, however, two
exceptions
to this rule described in R23. The first is the separated spouse of the applicant and the
second is where a child of the applicant who is in the legal custody of someone other than the
applicant
or an accompanying family member of the applicant, or where someone other than the
applicant or accompanying family member of the applicant is empowered to act on behalf of that
child by virtue of a court order or written agreement or by operation of law.

Did you receive AIP or SA? All you need to do now is to write another letter and you MUST include all your attempts in trying to contact and get your son and your ex husband. Or get a lawyer quick.

My ex husband has custody of him right now so what do I do from here?

Yes I recieved AIP letter so I should just write a letter and send proof of my attempts to contact him?

Thank you so much, I have another question I was divorced twice so when I filed permanent resident they only had space for one divorce so I put my most recent so I did not put the divorce from my children's father and that's who I have the restraining order on would this hurt my application? I didnt lie or try to keep out info there just wasnt a spot for a second divorce. I'm so confused!

The best scenario would have been to add a page mentioning the first divorce and an explanation.

Anytime there isn’t enough space to add all the required information you need to add a page to include the rest of the information needed.

(We had to do that for ours as there was not enough space for PA’s siblings and we needed to add an explanation as to why there was no father for PA listed.)

No informing them about your first marriage is a big deal. I wouldnt mention it since they are not saying anything about it. Just provide them with what they are asking.
