Hi
My son is PR Canada. We went there as family. But he came back India after spending 4yr there. Now he is in India for the last four yrs. He is working here as professional Photographer in film industry. His PR card expiring this August. He want to go back to Canada in October 2020.what should he do :
1.He should apply for PR renewal?
2.or he can apply for Travel document?
3.or he will have to apply for fresh PR application.
4.will his PR will expire with PR card expiration.?
5.will they give him travel document?

Pl suggest what should we do in this ticklish situation?

the permanent residency could be lost, he does not meet RO;
1.- he cannot apply for a PR card renewal, he is out of Canada;
2.- he can apply for a PRTD, it might be denied;
3.- perhaps he has to start a new application for permanent residency again;
4.- the permanent residency does not expire, it is revoked;
5.- could be.
if he enters to Canada BEFORE AUGUST, he has to stay within Canada for 2-3 years to meet all the requirements of residency
good luck
my suggestion is understands the meaning as a permanent resident, live in the country where the permanent residency was granted.
 
It is very unlikely a PRTD would be approved given being out of Canada for 4 years has failed the residency obligation.

Sure as above could travel before August but always a risk that on arrival could be reported leading to PR being revoked subject to appeal. If not reported would need stay put for 2-3 years before trying to renew PR card

Basically October 2020 would be too late given obviously card expired and unlikely to get a PRTD approved

1. No. He doesn't meet the residency requirement. If he applies, the application will be refused and he will lose PR.
2. Same answer as above.
3. His options are to travel to Canada before his PR card expires and hope he is not reported at the border for failing to meet the residency requirement. After his PR card expires, he can also try flying to the US and then re-entering Canada through a land border and hoping he is not reported for failing to meet the residency requirement. If he is able to do one of these things, he can then remain in Canada for 2 years straight without leaving and will be able to renew his PR card. If he can't or doesn't want to do any of these things, then he can also renounce his PR status and apply again from scratch through an economic immigration program like Express Entry.

Hello I am in the same situation I apply for a permanent resident travel document ( PRTD ) and they rejected because I didnt stay in Canada for 2 years of 5 and my pr card expire
I submitted an apeal for the obligation of residence and I am waiting for the answer

When did you submit the appeal? Appeals can take 1-2 years to process.

Hello I submitted my apeal in September they sent me that they recieved my appeal In October and they sent me my file by the month of December and now we will have a meeting in February
Hope all will be good and we will return to Canada
What about ur case ?
