Hi,

I am an Indian citizen with Canadian PR and recently got married and my wife lives in India. Given the timelines for spousal sponsorship(12 months), I wanted to apply for temporary visitor visa ( 3 months) for her and after she comes to Canada, I am planning to apply for in-land spousal sponsorship.

How long should I apply for the visitor visa?
How do I convince the immigration officer that my wife will have strong ties to India ( criteria for visitor visa ) ?

Hello,

TRV for spouses are very challenging, although majority of the cases do gets denied you still have a chance. Make sure to show your wife has strong ties to India, (i.e properties on her name, job offer letter for her days off, strong financial statements in her bank)

If TRV do gets refused, I advise you to go with Outland.

Not advisable to apply for a visit visa for 3 months, maybe 2-3 weeks only has a better chance. How long she can stay anyway will be determined by CBSA on arrival so could get 3 months or the default 6 months but asking for 3 months upfront in application can imply planning to stay.

If you are living in Canada right now, I would strongly recommend submitting an outland application now.

The TRV has a very high chance of being refused since IRCC will know your wife has plans to remain in Canada long term. If she wants to apply, she will want to show strong ties to her home country such as property, employment and assets. She should also have previous travel to countries such as the US and UK which require a visa.

You can certainly submit the TRV. However since processing may take several months, it would make sense to also submit the outland application so that you don't lose time in the event the TRV is refused.

Hi, me and my husband did the same mistake of applying for TRV and then got denied at the end even though I had applied for a month of vacation along with strong ties to return back to my home country such as letter from boss with details of my vacation, account details, salary certificate for 6 months and proof that I'm financially supporting my parents . Still got denied saying that they aren't satisfied that I would return back to my country after my vacation.
So I would personally recommend applying for outland as soon as possible as they are continuing to accept applications and not to waste time like how we did trying to get a TRV.
