PROXY MARRIAGE ASSESSED AS COMMON LAW

Good day all!

Has anyone had a proxy marriage that was assessed as CL and could share how they did it? I didn't know if was not allowed and my relationship is quite a long one so it is no problem to prove it is genuine. We've been living together with parents since 2018 so the cohabitation would not be a problem, and we've been getting as much info as we can, since we never thought we'd have to go to the CL route we didn't keep a lot of stuff and my partner's only bill goes to his previous address and he never change to my parents house since it is bill for cable, cellphone and wifi altogether, because sometimes we spend the weekends at his parents.

I am thinking I just should send my application along with a LOE and the documents i was able to gather to prove CL, is that it? Do you think I should say I didn't know it (we truly didn't so it would not be a lie, but maybe the officer thinks we are trying to trick them, idk)

This is not enough and will not work to prove common law. The answer has not changed since the last time you asked. What other concrete evidence do you have? You cannot prove ignorance by just explaining in a letter that you "didn't know" - if couples do not have enough evidence, even in genuine relationships, they simply do not apply until they do.

Of course your proxy marriage adds another unfortunate twist to the whole situation.

The proxy marriage won't be recognized at all.

To prove common law, you must show evidence that you have cohabitated for at least one year continuously. Generally peopel show this through joint property ownership / joint leases, joint utility bills, joint bank accounts / credits cards, mail with the same address.

An LOE won't be accepted in lieu of evidence. Saying you didn't know won't make a difference and IRCC won't care. IRCC will assess whether you are common law based on the hard evidence you provide to prove at least a year of cohabitation. You'll either have enough evidence or you won't. You can certainly try.

I am not saying my LOE will be based on a IDK. But i'd like to know if being franc is good in this case, if it won't do me any harm.

Of course your proxy marriage adds another unfortunate twist to the whole situation. That is the thing, I can easily explain why we did it this way. We entered the papers together but he had to travel, and we don't care about the paper, we will have a wedding party later on this year.

I did talked to a guy that received his PR and he and his partner one time were living at his parents, one time were living at her parents, so they made a LOE to explain.

We do have joint bank accounts, my partner is on my health, dentist and life insurance, we have a notarised lease with my parents where all of us signed, the statutory declaration of common law (even though idk if it is needed in this case or not since we are married, canada just do not recognise), notarised letters from friends, the wes document was sent to our current address, as well as mine and my spouses driver's license (there is no address on them in my country but we manage to keep the letter where they came from), pictures from our entire relationship (facebook and instagram posts), passport stamps from our international trips, money transactions between the two of us, call log from when he was away to prove we are indeed together. I have a bunch of thinks, i just need to know how ppl do it on their application to intro these documents and if it is okay to explain that you didn't know.

We have some documents and evidence, my question is if it is ok to explain we didn't know, explain why we did it, and that the solution now is that we'd like to be assessed as CL and for them to check all the evidence we will be providing. I am not worried about explaining my proxy marriage, it is not a fake marriage or an arranged marriage to a person i've never seen or i've seen like 5x times in my life. i've been with my partner for years, we just not much of traditional irrelevant things like signing a paper at 9am on a tuesday with 2 of our friends and party over it. what is special to us is being with family and friends and party all night and say our vows, so we didn't care much about the "signing the document" part. i will explain that on the LOE, but should i say we didn't know (what is true)? im not thinking it will weight on my favor, i just don't want to be something that will weight against us for some reason.
