Hi everyone, I would like to get your thoughts on my situation. I have obtained a study permit in March 2019 which was till 30th of September 2020. I entered canada in April 2019 with my husband (spousal work permit-same expiry date ) and my daughter (visitor visa-same expiry date). My visa was for an EAP and a one year program(graduate certificate) . I took EAP Level 8 from May to the end of June and stayed in canada doing nothing tell september when my actual program started. I finished last April and still waiting for my certificate to apply for my PGWP. I would like to note that the borded officer placed a restriction on my permit that I cant work outside my school since my acceptance at that time was for EAP and my husband had an open work permit. I have not amended the permit since I did not need to work. My questions are:
1.How long will my PGWP be and will my EAP count , I read on the website of CIC that it should count as it is not more that 50%of my study? Will they count the two months I spent in canada doing nothing as a study break ??
2. Can I amend my permit now to get an SIN to work ? Even though I finished school? I need to do that to find a job since the processing time for the PGWP is 120 days and I need to find a job so I can extend my husbands Visa ??
-When is the start date of the PGWP is , if I have to wait until its out to get an SIN dose that count that I am waiting without work until then or do I lose days just staying here ??
- If by any bad luck I don't find work until the 30th of september and will have to change my husbands status to visitor will he be asked to leave the country first or after the first 6 months ??
- I have renewed my passport and my husbands when at the beginning of this year ( the doomed year 2020) and our old passport had the stamps expire in december 2019 . I did not bother to ask for anew stamp since we did not leave the country and our permits are still valid .Was that a mistake ?Will that is any way affect our future PR plans??
Thanks for your replies. I hope I covered everything and I wish you all can help.

1. The English course doesn't count. Your PGWP will be whatever length your school says the program was.

2. It takes many months to amend a study permit. You really should have done it when you first could.

3. Your PGWP will be valid as of the date it is issued. As you did not amend your study permit, you will not be able to get a SIN and start working until your PGWP is approved.

4. He can change his status to visitor. Provided he maintains his status, he doesn't have to leave.

5. You didn't need to apply for new TRVs but it is always a good idea to have a valid TRV in case you need to leave and return.

If you are planning to try to get PR, you really haven't put yourself in the best position to qualify. You are unlikely to get the 1 year of work experience needed for CEC, especially since you won't even be able to work until your PGWP is approved.

Thanks for the quick reply , I think most of what you said is understandable. For the PR portion , i dont beed the 1 year work experience anyways my points are enough for express entry, my issue was with the gap time until I get other documents ready. As for the amendment the processing time on the CIC website is 30 days while the PGWP is 120 days , my question was am I allowed to submit amendment now even though I finished the program. As for the EAP portion, I really hope it counts since it will give me an additinal 2 month.

Again thanks for the quick reply , highly appreciated!

Everything is significantly delayed due to the pandemic, so expect it to be several months for the study permit amendment. You can apply.

English courses don't count towards PGWPs.
