Application for Citizenship & Moving to Australia then Applying wifeès PR

Hi Seniors,

I have too many questions and want to plan well , so trying to put my case facts as points below:

-I will be applying for my Citizenship in May 2021 and hope to get it in 2021 itself.
-As soon as I apply for my Canadian Citizenship I plan to get married and shift to Australia to unite with my would-be wife who is an Australian Citizen.
-Once married ,I will apply for Australia PR.
-I will be based in Australia and be working there for a few years.
-Both of us plan to move back to Canada after a few years so I want my wife to have Canadian PR too


Queries:

1)Regarding my Canadian Citizenship

-Can I leave Canada and go to Australia , immediately after applying for my Canadian Citizenship , without jeopardizing my Citizenship application.
Or
-Do I have to wait for my Citizenship to come and then leave for Australia .


2)Regarding my wifeès Canadain PRship

-How soon can I apply for my wifeès Canadian PR.
-Do I myself have to be paying taxes and residing in Canada ,to apply for her Canadian PR and can I do it while in Australia.In that case I wont have Canadian income nor Canadian residence.
-Can my Australian income be counted toward satisfying the income criterion for her applying for her Canadian PR.

If I were you, I wouldn't assume something like this. The official time for processing is 12 months. However, the average is around 6 - 9 months for a sizable number of applications. If your application is considered non-routine, then it might take longer than 12 months. Don't "assume" that it will be processed the same year - give it a minimum of 12 months and plan accordingly to avoid disappointment.

Yes. You can leave Canada after we receive your application.

If you need to leave Canada and want to stay eligible for Canadian citizenship, you must:

• make sure that you live in Canada long enough to keep your Permanent Resident (PR) status
• be a permanent resident (when you apply)
• not lose PR status before you take the Oath of Citizenship
• bring your PR card with you when you leave Canada so you can return easily

Make sure your PR card won’t expire while you are outside Canada.

We usually only mail letters, notices and other documents to addresses in Canada. In some cases, you may receive an email from us. You must reply to these letters or emails within a specified amount of time. If you don’t reply within the time frame and don’t provide an acceptable reason for not being able to keep your appointment with us or providing requested information, we may stop processing your application.

You must attend appointments and other events at our offices, like your:

• citizenship test (for applicants 18 to 54 years of age)
• interview or hearing
• ceremony

You can file a sponsorship application anytime. However, it doesn't make any sense to sponsor her until she is planning to move to Canada in the near future. To maintain PR status, physical presence of 2 years in every 5 year period is required. So, plan accordingly and then apply.

-Do I myself have to be paying taxes and residing in Canada ,to apply for her Canadian PR and can I do it while in Australia.In that case I wont have Canadian income nor Canadian residence.

While Canadian citizens can apply for spousal sponsorship when residing outside Canada, you'll have to substantiate that you plan to live in Canada once your spouse is approved to come to Canada as a PR.

Who is eligible to sponsor their spouse, partner or child
You can sponsor your spouse, partner or dependent child if:

• You’re at least 18 years old
• You’re a Canadian citizen, a permanent resident of Canada, or a person registered in Canada as an Indian under the Canadian Indian Act
  • If you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when the persons you want to sponsor become permanent residents.
  • You can’t sponsor someone if you’re a permanent resident living outside Canada.
• You’re able to prove that you’re not receiving social assistance for reasons other than a disability
• you can provide for the basic needs of any persons you want to sponsor

-Can my Australian income be counted toward satisfying the income criterion for her applying for her Canadian PR.

Generally speaking, there is no income requirement to be shown when sponsoring a spouse (unless your spouse has a dependent who in turn, has another dependent).

In most cases, there isn’t an income requirement to sponsor your spouse or partner or dependent child. You only need to show that you have enough money to meet the income requirements if:

• you’re sponsoring a dependent child that has 1 or more dependent children of their own, or
• you’re sponsoring a spouse or partner that has a dependent child, and their dependent child has 1 or more children of their own.

In order for your spouse to receive PR you will have to show that you plans to relocate soon after receiving PR. Quite a lot of concrete proof that you are moving is required. For that reason you should only apply for PR for your wife when you plan to move in the year or so.

BTW, you will need to fly back to Canada twice for test and ceremony with short notice,which kind of sucks since AU and CA are pretty far away.

Don't expect to get citizenship in 2021. With the pandemic delays, apps will likely be delayed for quite some time while IRCC catches up.
