Hello All, returning back to this forum after a long time. I will be very happy and appreciate if someone can advice me based on their recent experience

I am a PR in Canada for the past year. I went to India for about two weeks this March, got married and returned back to Canada alone. Wife lives in India, with no prior visa history or international travel ever.

When our marriage was getting materialized, my wife did try to apply for a visitor visa in Jan and got rejected due to insufficient proof to return. The rejection says she can reapply again. Its seems she had applied on her own without showing any of her financial statements or employment proofs. Now we are planning to apply for a visitor visa again and do an inland-PR application once she arrives here, as the outland-PR application might take over an year given the COVID situation.

Currently she works for a large bank as a manager, she can get a NOC from her work for a two week travel in say oct or nov. She does own a decent amount on FD and other financial assests on her name. Also this time we are planning to use a professional immigration consultant to help us with the documentation and filing process. I am planning to sponsor her travel, I make more than adequate income and own my home here in Canada. Given all this I need your assistance with the below?

So will this be a good idea to proceed with the visitor visa? at this point during the lockdown? has anyone succeeded in securing a visitor visa in the past month?

In case if the advice is to proceed with the visitor visa, then am I missing something or will anything else help us increase the chance of succeeding?

The chances decrease dramatically now that you are married. You don’t need a consultant you can apply on your own. Processing is much lower at the moment and India is on lockdown. Would prepare your outland application at the same time so if you get denied you can apply for the sponsorship right away.

She can try for a TRV but with a PR spouse, zero travel history and a previous refusal, her chances are quite low.

I would very strongly recommend submitting an outland sponsorship application now.

Very high chance the TRV will be refused since IRCC will suspect she has plans to come here and remain long term.

If you apply for the outland application now, the application will be six months in before her planned trip in October. If the TRV is approved, she can still travel here in October / November even with the outland application in progress. No sense in waiting, apply outland now. That's absolutely the best course of action if you want to be reunited and be able to live together as quickly as possible.

Many thanks! Will start the outland application right away.

This leaves me with two questions,

1) Can we apply for TRV , when an outland application is in progress?
2) In case if the TRV is approved after I applied outland, will I be able to cancel the outland, make her travel and then apply inland?

1) Yes.
2) Sure, you can cancel the outland application and reapply inland.
