Dear Sirs,

I am a single mom from Serbia, father's name is not in my kids' birth certificate; we were not married, either. My son is 6 and I am 43.
I've university degree, speak English Russian some Polish and basic French; did not take IELTS yet and have just started looking for a job.

1. What is your reccomendation at what point and how to start working towards my immigration visa; 2. What type of visa; 3. How long would it take and how much will it cost approx., and 4. what about these agencies offering services?

I would not consider immigration without my child.

Please advise.
Would actually look if you qualify. At 43 it will be difficult and you can only estimate your CRS score without your IELTS.

Yes we are separated. But I don't have any documents relating to it
If you can show you are separated, you can exclude your spouse. Filing for divorce is the easiest way to show that. You will need sole custody or permission from the father for the children to immigrate.

Hi, thank you for your replies so far, they have been really helpful. I'm a single mum of 31 to a son in Nigeria. I commenced the express entry process and I've written my IELTS with an overall band score of 8. My WES evaluation is ongoing and I've been able to process my son's passport with an affidavit sworn to confirm my single mother status. My Daddy's name is on my son's birth certificate as his dad too. Can my dad sign the consent form for the PR application since he appears as my son's father on his birth certificate? Does my dad need any other legal document to show paternity since his name is already on my son's birth certificate?

Why is your father's name on your son's birth certificate as his father as well ? I might be wrong, but that might raise a few eyebrows

Unless your father is the actual biological parent you have to attempt to have the real father sign off that your child can leave Nigeria. If Nigeria gives automatic custody to the mother you can provide that information.

Agree with Copingwithlife.
Your dad shouldn't "appears as your son's father on his birth certificate. " If you do not know or do not want to put down your son's biological father on his birth certificate, I think you should have leave it blank or unknown...

This doesn't look right to have grandfather's name appears as father. :(
See if you can find a way to fix it.

Dear all

I would like to know if presenting the court custody document waive off the requirement of MM5604 form (signed by the non-accompanying parent)?

Hello everyone,

I am a single mother of 2 boys ages 5 and 3. I already have my profile in the pool with a score of 451. I started my divorce case but it is still pending in court. However, I went ahead to do a separate case for custody of my children at the Magistrate court. That verdict came out in time and I was granted sole custody of my children and sole responsibility to make decisions on their behalves. The document also gave visitation right to the father which will be agreed on by me.

The divorce case is close to an end but I cant say for certain when that would happen, although the outcome of our mediation would be adopted where I also get sole custody and responsibility of both children with visitation rights to their father.

My question is, can I use only the Custody document to apply for my kids or do I need to wait for the Divorce papers (There is no telling how long it will take it has already been 2 years in this process). would I still need a consent form from their father?

You can use the custody document.

Assuming you are a FSW applicant (vs. CEC), you should see what you can do to increase your score by retaking IELTS, etc.
