Hello,
I need advice on a multiple visa entry for my parents. My parents are currently in Canada on a multiple visa entry that expires on November 15th, 2020. We have extended their stay in Canada until June 10th, 2020. Their passport expires the same day as their multiple entry visa which is November 15th, 2020. We have submitted humanitarian and compassionate application last year on August 12, 2019. We got a confirmation letter saying that they received file. It is not in process yet. Are there any possibilities for them to stay in Canada until we are waiting on a decision? I have already checked that we can apply for a new passports in Canada at our Embassy but can we get new Visitor visa within Canada? We don’t wont them to go back-home while we are waiting on a decision especially now that we are facing COVID-19 virus.

Any information would be helpful.

You'll need to obtain new passports to start and then apply to extend their stay in Canada as visitors. It's not possible for any of us to say if they will be approved or not or how many times an extension may be approved. If they are eventually refused, then can try to continue to remain in Canada without status while they wait for the results of the H&C application. Note that H&C applications are generally taking around three years to process at this time. So I would be expecting they still have more than a two year wait ahead of them before they have an answer.

I see. Yes, you can apply for an extension until their passports expire.

In terms of remaining in Canada without status - no, it's not technically legal (since they don't have status). But it's feasible and some have been successful.

They have been here a long time now and it's hard to say how much longer IRCC will keep approving extensions.

Sorry to bother you, one more question, I have read little bit about Restoration Status within 90 days upon expiry of their visa. Would that be applicable for my parents?

You mean if they are refused? Techically yes, but generally the chances of resotration being approved are pretty low if IRCC has already refused an extension. If an extension is refused, that's IRCC's way of telling someone they've been here too long and need to go home.

Yes let’s say if they are refused or maybe even to wait when their multiple visa expire and than apply for restoration because we have 90 days to apply from the day visa expire. Of course I would be first applying for a new passport before I do any of it. They are here quite a long, just hoping and praying that H&C application will be approved.

I am sure you are already aware that applying for H&C is very risky especially if both your parents are alive. This is an example where a parent was not approved. If your parents are denied an extension their options are to remain in Canada without status or return home and wait for their a H&C outcomes. Overstaying a visa has implications for any future travel.
