Hi @legalfalcon

Your expert suggestion is required.

Background:
  • Got approved LMIA – Owner operator, NOC - 0013 in Dec’2018 (valid till Jun-2019)
  • Applied for EE-Outland using LMIA on 29th Mar’2019 – for self, wife and son - already completed 12 months
  • Last status is: Eligibility – Recommended Pass, Criminality – Pass, Security – Not yet started; agents on phone say additional verification is required
Questions:
  • The Canadian job offer provided by my own company as part of Owner operator was issued for 1 year and has expired in Dec’2019. Is that supposed to be issued again and resubmitted with IRCC?
  • LMIA too has lost its validity in Jun’2019. Should it be applied again and resubmitted with IRCC?
Please advise.

The file transfer has no significance. Most filed are transfers due to work load distributions, and others are transferred to LVO as usually it is LVO which sends a PPR and does the final processing.

Also, in some cases for applications where local knowledge may be required, the file may be transferred to the LVO for further investigation.

To know the exact reason and if your eligibility has passed, send a CSE and ask or request your GCMS notes.
Please mine has exceeded 6 months and gcms notes state not started for all....my file was transferred from Edmonton to Accra in October and then from Accra to Hong Kong January ending...both state for work load distribution....I really wonder why all state not started...im a bit confused

In which section did u see the reason (work load distribution) for your file´s movement?

@legalfalcon : I am srilankan national migrated to India in 1999 as a dependent child in my mother's passport due to the Srilankan Civil war.

I have been living India since then. We didnt seek any Refugee claims from the government. We registered our details with the local police authority and whenever we change address.

Now while applying for PCC at FRRO they have denied issuing me a PCC stating that they need a Refugee Card or a Special Registee Certificate (FRRO) which we don't have.

I tried to Register with FRRO now they deleted my application stating they cant do it now as irs already 21years.

When I approached local police station they told for Foreigners PCC will be issued only at FRRO and they cant do anything.

What should I do now??

Kindly help me on this. I received ITA on March 19th under PNP from Ontario

It seems really weird that why has he not reviewed my customer service manager experience at this time. This is a mistake made by the case analyst and I am worried what should I do at this point of time. It has been 2 months already that my file is not touched after the review required comment. I have a uploaded new experience letters and CSE exlpaining about the mistake made by the case analyst.

One of my reference letters has duties 100% copy-paste word for word from the CIC NOC. I left that firm on bad terms, not sure whether I can fetch a new modified letter.
What are the best practices in this situation ? I've researched & read lots of mixed advices..

I have : Payslips, offer letter, Dubai stamped visa on the passport.

You will have to show your status in India to obtain your PCC. You should contact the Ministry of Foreign Affairs or tag the Minister on Twitter to get your case through. The offices in India have a stringent red tape and will not do anything unless the book says. If you are unable to obtain a PCC, you can submit your application and in your LoE explain this in detail, including any documents to support it.

Understanding “Review Required”

A lot of applicants see “review required” in their GCMS notes for eligibility. There are many theories floating around with regard to what “review required” means and if it is alarming.

Before I venture into explaining the significance, it is important to understand that each application goes through the following stages as per the Immigration and Refugee Protection Act and the regulations (Canadian Immigration Law):

R10 – Completeness Check
Criminality
Medicals
A11.2 – eligibility
Security

Out of the above, the most important stage is eligibility. This is also the most time-consuming stage because your documents have to be verified, evaluated and assessed to ascertain that you meet the eligibility criteria for the program you have applied (FSW / CEC / FTW). To stream line this process and make it easier for an immigration officer (decision making authority), all applications are first evaluated by case analysts or program assistants. They review the documents and summarize it in the GCMS. If they have any concerns with any document or want the immigration officer to carefully look into a specific document, they will flag it as “review required.” It is the content of the note that is important here. If the review required is for a specific document, while the summary of the note says that an applicant has met the eligibility, or “ready to finalize” it simply means that while the applicant has met the eligibility criteria, but the specific document needs a careful examination form the officer before promoting (eligibility pass) by the officer.

However, if there are concerns, there will be a review required for the eligibility, and there will be no text to the effect “ready to finalize” or pass. The note will specifically state job duties do not match, or the employment cannot be verified, or the number of years of work experience claimed cannot be verified. This is where an application can land in muddy waters. But the final decision rests on the immigration officer. He may override the decision of the analyst / assistant or go with the analysis of the analyst / assistant.

Even in cases where the analyst / assistant is of the opinion that the applicant has met the eligibility, and there is no “review required,” the officer can replace it with his own opinion. Though rare, but it does happen. This is why the eligibility is only passed when an officer conclusively marks the eligibility as passed.

Finally, there is “review required” for PoF. This is the most common in many applications. This is because, the financial and banking practices of each country are different. Eg. Fixed deposits are know as Certificate of Deposit (CD) in the US. Similarly, treasury bonds, mutual funds, stocks, and many other investment vehicles are there. If your PoF anything other than a bank deposit, it is more likely that it will be marked as “review required.” Also, IRCC does not go by day to day fluctuations in FOREX. Instead, the Canadian federal government issued a quarterly conversion rate for all FOREX vis-a-via CAD. If your PoF is in a foreign currency, then you may have “review required” for the officer to make a determination.

Just because you have “review required” does not mean that you hit the panic mode. Instead, read the context in which it is there. If there is a concern regarding a document, you can send a replacement document via CSE. The most common reasons for RR are:

1. Work reference letter without job duties
2. Work reference letters missing all the details requested by IRCC
3. If you submitted a letter from a colleague because you were unable to get one from your employer, but did not have a LoE on file, this too will lead to RR.
4. Not sufficient work experience in the primary NOC.
5. Inability to verify your employment as your employer details are missing.

There are just some of the scenarios.

This is a generic response. It means that your eligibility, criminality, is most likely passed. To know the details, you have to see GCMS notes or call IRCC.

A a rule of thumb, you cannot copy paste the job duties.

If you have done it, you cannot do much now. If you have included the documents to support your work experience along with your reference letter, i.e. Payslips, offer letter, Dubai stamped visa on the passport you are good.

I have only showed one-year of Canadian work experience. But the case analyst just reviewed my department manager experience and not the customer service manager experience. Both my work experiences make one year.
He has not assessed my customer service manager experience and infact comments that the other Canadian work experience is not required to meet CRS score.
He only assessed my department manager experience for 10 months.
