Spousal Sponsorship/Implied Status Questions

Hello!

I had a question regarding the spousal sponsorship application. I know that I must include a marriage certificate within the documents as proof of marriage.

  • Do I need to send in the actual certificate or am I able to make a copy of the certificate and then send the copy?
  • Is there a website regarding this matter of being able to send a copy of the certificate or not? I cannot seem to find anything about it. If so, may you provide the link?
I just received my marriage certificate in the mail today. However, I applied for a visitor extension since I was flagged and have to leave Canada by March 26, 2020.
  • If I were to mail my spousal sponsorship application by this week, does that mean that I applied for a visitor extension for no reason?
  • I plan on applying for an OWP as well, so how does the implied status work? Once I mail my application, am I given an implied status immediately or what happens?

Do I need to give my biometrics. If so, how do I give it? Do I get my biometrics done before I send in my application? Or is it after some processing time, I would receive a letter saying I need to get it done?

Also, for form IMM 5406 the additional family information, how do I get my family members to fill it out? Is it possible for them to take a picture and send it to me or does it have to be scanned?

You will get implied status once you send your OWP application. But if the application is incomplete it will be returned and you will be out of status. And with the COVID 19, they wont be returning incomplete applications immediately, they will set them aside for around 90 days, making your situation worse. To be safe, its best you apply to extend status (you can attach your PR receipts and ask for an extension for the time that the PR is being processed)

you can find out if you need to give biometrics here https://www.cic.gc.ca/english/visit/biometrics.asp they will let you know when you need to go have it done.

Your family members will only fill in imm5406 if they are accompanying you as dependents (over 18yrs). if they are then they should download it sign it and post it to you

As stated in the guide, unless your country-specific instructions state originals are required, you only submit copies.

Implied Status starts after your current status expires, so March 27th.

  • Would you know if many people got declined or approved on this step?
I'm a little worried about this stage. My SO and I have been online dating since 2014 and I've been visiting from 2015 till now. It's not the proof that I'm afraid of because I have plenty of photos and messages to show that we've been together.
The part that I'm worried about is the marriage. We solely married for my husband to sponsor me. The marriage was also recent (12/31/19).

Probably. IRCC has stated that incomplete apps will be retained and reviewed in 90 days.

You need to meet the proof requirements. You can take out an insurance policy and name each other beneficiaries.

Your marriage is fine. You have a long relationship history and are American, so you are not a Marriage of Convenience risk.
