  • If the applicant’s CRS score at the time of the e-APR is equal to or higher than the lowest-ranked score in the round of invitations, the application will not be refused under section A11.2, as long as the applicant’s supporting documentation corroborates their claims and they continue to meet the MEC for Express Entry, including the requirements of the program to which they were invited to apply.
  • If the applicant’s CRS score at the time of the e-APR is lower than the lowest-ranked score in the round of invitations, the application should be refused under section A11.2 for not having maintained the qualifications that would justify the ITA.
As per this rules i am filling my e- APR this week. I have completed 52 weeks in B - NOC job in Canada and have got the ITA on 13, Nov 2019 under CEC. While i received my ITA i have completed only 50 weeks of Canadian experience. Still i am hopeful to file the e-APR this time since i have completed 52 weeks as of now.

After all the suggestions and critics i am planning to submit the e-APR supporting the following statements.

"If the applicant’s CRS score at the time of the e-APR is equal to or higher than the lowest-ranked score in the round of invitations, the application will not be refused under section A11.2, as long as the applicant’s supporting documentation corroborates their claims and they continue to meet the MEC for Express Entry, including the requirements of the program to which they were invited to apply."

"
Under section A11.2, an officer may not issue a visa to an applicant who did not or does not meet the Express Entry minimum entry criteria (MEC) or did not or does not possess the qualifications for which they received their CRS score at the time when

  • the invitation to apply (ITA) was issued; or
  • the e-APR was received by IRCC."
Hoping anyone who had been in this similar situation would comment.

Thanks Harry

This looks like a grey area to me. It could go either ways, but I would like to think that qualifications at the time of e-APR trump the qualifications and score at the time of ITA. For example, if someone got 475 during ITA and they end up having only 445 due to inaccurate information (age is an exception), it only makes sense to refuse the application. While on the other hand an applicant makes a profile with correct information (mind you, it's the system that takes it in months, not you misrepresenting) and end up getting an ITA for the correct information, but submit e-APR after gaining a year of experience, it shouldn't be a big deal. Then again, it's my opinion and I could be wrong. What did you end up doing?

Looks good to me. You can also order GCMS notes to see if you went pass section 11.2 in the preliminary evaluation. If it shows as 'met,' you should not have any problems with it. Do you mind if I ask you how long it has been since your e-APR?

It´s actually the other way around. You must meet the MEC at the ITA (as well as at the eAPR). For the CRS points, it will be enough to meet those at the time of the eAPR.

https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/permanent-residence/express-entry/assessing-electronic-application-on-section-a11-2.html

"Applicants must meet the MEC to be accepted into the Express Entry pool and must also meet the MEC when they are issued an ITA and when they submit their e-APR." Doesn´t look grey to me.

As for the CRS Score:
"If the applicant’s CRS score at the time of the e-APR is equal to or higher than the lowest-ranked score in the round of invitations, the application will not be refused under section A11.2, as long as the applicant’s supporting documentation corroborates their claims and they continue to meet the MEC for Express Entry, including the requirements of the program to which they were invited to apply. Just out of curiosity, did you have any work experience in your home country prior to getting the ITA? I understand that you got your ITA before completing a year of Canadian work experience.

If it was continuous and within last 10 years, you might have qualified for FSW. Did you claim points for it? If you didn't meet MEC for CEC, but met MEC for FSW, they might still consider your application.

Hello!
I am little confused about the completion of my 52 week work experience. I started working on Feb 19th, 2019 . Unfortunately between March16th,2019- April 26th 2019 (6weeks) I was on unpaid vacation as I had to go back to India due to personal reason.
I submitted my express entry profile on March 26th, 2020 . ITA received April 16th,2020 under CEC.
Excluding my 6 weeks unpaid vacation, I got my ITA on 55th week of work experience. I hope this might not be effect my eligibility?

Planning to accept my ITA and submit e-apr in the month of June.

PS- I am temporarily laid off from work but hopefully that I will be rehired in upcoming 2 weeks.

Any advise on my situation much appreciated!
Thank you,

I think it all depends on your hours completed. If you are unable to provide the proof of completing 1560 hours within the time submission of documents they would reject the application. Make sure you do meet that before submitting the documents.

Thank you for your response.
I worked 42-44 hours per week. Soo my total hours are well above 1560 hours. Also, I have all the Paystubs, T4 and NOA to support the claim.
Am I good to accept the ITA?
