I have been conned by a Job Consultant in India and he has given me a fake LMIA which I had submitted along with my Open Work Permit document. I have been refused Visa and banned for 5yrs.

I have filed a police complaint and also case in Indian Court against the Consultant.

I want to know I can re-apply for Canada Visa with my case fact that I didn't had any idea of the LMIA document being fake and also I have taken action against the consultant also.

No - at this time you cannot re-apply for a Canadian visa. You are banned from Canada for 5 years.

If you want to try to overturn the ban, you will have to hire a lawyer in Canada to represent you. IRCC holds the applicant responsible for ensuring that all documents in the application are accurate and genuine. Even if you hire a lawyer to appeal the ban, there is no guarantee it will be overturned.

Everything in the app, including the fake LMIA, was your responsibility. It is unlikely you will get the ban overturned.
