That’s a lot of time! Have you already requested the GCMS notes or speak with an agent?
35 months and they haven’t started processing your application? What does your lawyer tell you?
unfortunately there has been a huge volume of extra H&C cases because most who are refused asylum file H&C cases and there are many others trying for H&C RO try and stay in Canada for a variety of reasons. There does seem to be some changes going on but if you were already in the system before changes were implemented your case will likely take longer. Many people don’t actually complain if they have a work permit and prefer for their cases to drag out as long as possible.

Dear All,

We would like to ask: - is this student who got seriously sick after months of studying in Canada, and almost become a disable person presently - can be eligible to access any non-profit agency's programs to help supporting her to learn new skills here, or meet people who has disablility like herself here in Canada? Is this activity will harm her H&C application??

Thank you.

Hi , please suggest me. My H&C app is in process , they sent medical exam request form .

Is it a good sign ? What stage i am on stage 1 or 2 ?

Also CBSA asking me to sign Travel Document Application form , because my travel document is expired couple of years ago. So on 1 side i have some good news that my file is being processed , but on other side CBSA forcing me to sign papers. What should i do . Please suggest if anyone faced this . How to handle it.

Thanks

No she will not have access to any form of retraining or learning new skills. If she is able to learn new skills why isn’t she applying to go back to school? There may be a free support group that is run by a volunteer but nothing organized through a hospital. The fact that she is disabled will not help her H&C application unless she has no access to treatment in her home country. You use the term disabled very loosely. Disabled people can be students or work. She is also no longer a student and it’s unclear whether she ever studied in Canada.

Still unclear about her private insurance. If she paid her full year of tuition she likely had access to a full year of health coverage through her school. If that is the case she should be preparing for her insurance to end. If for some reason she has been using the school insurance but withdrew she should be aware that the insurance can come seeking repayment. I couldn’t see how she could get private insurance after getting sick to cover her current disease/condition. I hope you are working with a lawyer who is giving you realistic expectations. H&C is a long process and it is going to be very difficult.

It’s positive sign your still in first stage of H&c if you get your Aip then cbsa stop your removal.
If you don’t Cooperate with cbsa officers then will detain you and force your removal

AIP means
(Approval in principle)
It’s hard to say depends on officer
In my opinion should be soon in few months

Many H&C have been taking over 3 years so it is very hard to tell. Believe you at around 22-23 months. I think a few months may seem ambitious but there are no standard times for H&C.

Yes it’s normal
Unfortunately Some of H&c officers are not updating in system but application should be in process . Everything would come all at once

Hello everyone, My husband and I came to Canada on a visitor visa and applied for H&C by consultation with a lawyer on hardship in our country. After 6 months, we applied for a visa extension and then received a letter from the Edmonton Immigration Service stated that your visa was approved for another 6 months. And then you must leave Canada, what if we don't get a response from the Immigration Service within another six months? And do you think there is any chances for us to get PR? We didn’t want to be refuge and now we are stayed in Canada 9 month without any job and study.just waiting...
