OWP Implied Status? Mid PR and transition from IEC

Hello everyone,

I am trying to figure out whether or not my partner is able to work while our current Commonlaw PR Inland application is in progress. We applied for the PR back in August but we did not at the same time apply for the OWP for some stupid reason I don't remember. We have since applied for the OWP the 2nd week of December (so its been maybe 7-8 weeks since). My partners IEC visa expired yesterday on Jan 31 and was not working at the time as we did a quick visit for the holidays back to the UK for my partners family. My question is since we applied for the OWP and my partner is back in Canada here now waiting out for the PR does this qualify as implied status and/or does implied status allow for my partner to get a NEW job now, or do we have to wait for the OWP to be approved?

I have heard implied status really means that they can continue working if they had an existing job, but since my partner left it and is currently unemployed I don't know if that means they can get a new job or not or we need to wait. If we have to wait how long should we expect to maybe wait for the OWP to be approved given its been about 8 weeks already?

Hope somebody can help us out , and thanks in advance :)

If your partner returned to Canada before the IEC work permit expired, s/he can work. The issue may be finding an employer willing to hire her on Implied status

Implied Status has nothing to do with having a job.

If your partner returned to Canada before the IEC work permit expired, s/he can work. The issue may be finding an employer willing to hire her on Implied status

Implied Status has nothing to do with having a job.

OWP takes 3-4 months.
Hi, thanks for the reply. I think I was confused because I heard that you needed to be CURRENTLY employed to transition from a previous visa in to implied status (and still continue to work). But, you're saying that legally they can still work while waiting (if an employer is willing to hire them)?

Why would an employer be less willing to hire, would it be due to lack of specific documentation (being that the IEC visa is currently expired)?

As I said, Implied Status has nothing to do with being employed.

Employers are required to verify a person's right to work in Canada. There is no documentation when a person is on Implied Status, so it depends on the employer's willingness to accept that.
