Regarding Marriage Certificate for Canada Immigration

Problem Statement: We were married back in 2013 under Muslim (Islamic) law but unfortunately, the marriage was not registered. We went to the Registrar Office - Madhya Pradesh, India where they expected us to produce a Nikah-Namah (mandatory) which was not available to us. Further we also contacted the Qazi (Muslim Marriage Official) but as per them, there is no entry of the marriage in their records.

I am stuck at the moment and looking for a possible solution so that we can proceed with our Canadian PR process.
Few points to ponder:
1. Is it possible to perform a court-marriage in Madhya Pradesh India and then get a registered marriage certificate? Will this marriage certificate be considered. Please note that we have 5 yrs old child with us.
2. Is there any alternate document which can be produced instead of marriage certificate?

Kindly suggest a way forward.

Western countries have children outside of marriage from a long time. One can have children from a previous marriage too. So, a court marriage can be done any time. You have to bring two witnesses, one from bride's side, other from groom's. About Nikah-Nama, the advocates will find a way.

Unfortunately, no. I had to do the court marriage last year for myself. My daughter was 3 at the time. Though I had the Anand-Marriage Certificate, they just read it for confirmation.

In the meantime, apply for ECA if you haven't done so. It can take around 6 months, valid for 5 years, and you will save a lot of time by doing it beforehand.

Thanks. All is done and our application is in the express entry pool and we are meanwhile sorting this marriage certificate out. Hopefully it resolves asap because this has been a real pain for us.

I hope this court marriage certificate works out and is accepted by CIC. By any chance, have you come across someone with this situation? Our agent confuses us a lot sometimes.

i am in the same situation , i have english certificate from waqf board which im scared if it will be accepted also my passport updated with spouse name . How did u sort the situation with marriage certificate ?
1]did u go back to india and got your marriage registered with 30 days notice
2]is there any other method to register marriage as my marriage is already solemnized and i do not have much time . I received ITA and i am really worried . Please respond .

If necessary, get your marriage registered in your current country.

Like Raj said, you should get your marriage registered as Nikahnama or any other local certificates will not be accepted.

1)I have got the certificate attested by Ministry of external affairs would that work?
2) if not how did u get it registered did you go back to india and followed the 30 day process?
3) My concern is i am applying as a single applicant with un accompanying spouse at the moment if i submit my existing certificate and write a LOE that i would submit the document as soon as i get it registered would that suffice?

please let me know

I am not sure if that certificate will work because IRCC looks for a marriage certificate issues by the authorised body like Nagar Nigam or the District Magistrate or Collector.
I took the help of an agent who did all the work for me and we were given a date to visit before the District Magistrate to sign in physical. Thats it.
If you declare your marriage then it doesn’t matter whether your spouse accompanies you or not. I would suggest to declare correct information along with the marriage certificate.
@rajapanesar can suggest more.

My family visited the registrar office to apply they have given a day to sign in front of registrar , but it would exceed the deadline time of my ITA . Can i write an LOE explaining that i have filed an application with acknowledgement receipt from the registrar office and submit my profile and later update the certificate as soon as i receive it . Would that work? Or will it be an incomplete application.
