Issue with Work- Permit

Hi there,

My name is Dimple Patel and I am an International Student from India. My issue is with respect to PGWP. I did my Masters in Education from Public University and the course duration was 16 months, which was expected to get completed in 12 months as no regular vacations were given and no scheduled break were given. It was an intensive course and we are eligible to get 3 years work- permit.

All my classmates got work-permit for 3 years whereas I was issued work-permit only for a year. I called CIC and spoke to a officer. He verified all the details and said that I am eligible to get work-permit for 3 years and asked me to wait for a month and I should get an update from them.

After a month I got an update from them which states that the decision remains the same and they did not specify any reason for issuing work permit only for a year.

Can I re-appeal to them and ask to reconsider it? What additional documents can I submit for convincing the officer? Out of 50 students, I am the only one who is issued PGWP only for a year.

Or do I wait for a year and later ask for extension, and for extension do I would need a letter from an employer? I haven't got a full-time yet.

Please guide me, sincere inputs would really be appreciated.

Thank you so much :)

You cant get extension so its now or never, extensions are only for when you are given short time because of passport expiry.
So you studied 12 months only? The rules around that are not very clear, if you read them you will see they can consider actual study time not duration of course.

You did not provide sufficient documents that grants you a 3 year pgwp. You cannot based what you think you'll get on your classmates decisions.

All the additional documents were submitted. I spoke to CIC Officer and he verified all the documents and mentioned that it was perfect. There was no issue with my documents.

I am planning to re apply. Is it mandatory to have a full time job in order to get work permit extension?

Best thing you can do is get your university/program office to write a letter of explanation or confirmation and reapply with that. I don't know your situation but even reading your paragraph caused me some confusion. How can a 16 month program be completed in 12 months?

16 month programs are usually
Summer
Fall
Spring
Summer

Are you taking full time in all of those semesters?

Hello,

I completely agree with it. The program got completed within 12 months and it was scheduled in the same manner. I had 4 semesters and it was full time. My transcripts also mentions the same. I can always ask for a letter of explanation but hope they give me as I am an alumni now and not a regular full-time student.

I also wanted to know that if embassy is not willing to change the decision and issues the work-permit for a year, do they give any reason for that?
I did follow-up with CIC and they asked me to wait for a month for the update and I did the same. The latest information from them mentions that their original decision remains unchanged and they did not give any reason for that. Is this how they work? I expected a reason from them so when I re-apply I can give explanation for that.

Thanks for your response.

If you went to a decent institution, they should go out of their way to help you. Being an alumni is for life. Contact them ASAP and have them explain that it is a 16 month program with 4 academic terms of 15 or more hours of learning per semester. Provide your transcript, reason for reapplication - even mention the conversation you had with the CIC rep that you referred above. This is what I would do if I was you but...

at the end of the day you are at the mercy of the government, the CIC rep and the best you can hope is that they reconsider. The Canadian government is allowed to interpret your situation as they see fit and have every right to do so.

Attempt your best to succeed but also start making contingency plans.

There are no extensions for pgwp.
Given your explanation above it seems you studied 12 months only so I dont understand the whole 16 months thing and you were correctly given 1 year permit. Difficult to say why your classmates got 3.
