Hi,
I am sponsoring my partner as a Conjugal Sponsorship. Almost completing the forms and chats. My partner and I had the same sex marriage done in HK -LGBTQ. We tried to apply for TRV but she got denied. Can someone help me out how to do attestation. under IMM5629 SUPPORTING DOCUMENTS FOR SPONSORED PERSONS(RPINCIPAL APPLICANT AND ALL FAMILY MEMENBERS) # 7. Proof of Relationhip to Sponsor " A Written statement attesting to the fact that you and your sponsor are unable to live together and explaining why." Currently my partner is living in the Philippines and working there and i live here in Toronto. We have been together since 2016. Yearly i go back home to be together and do travels.

If you're married you can't do conjugal. Apply as a spouse.

i do understand that but our Marriage is not legal due to same sex is not legal in the Philippines for marriage. and it is a so called Holy Union to LGBTQ, binding 2 becomes !.

That's irrelevant. If it was legal in HK and is legal according to Canadian law, you can only apply as married, and NOT conjugal partners.

If your marriage is (legal) and recognized in the country you married then canada will recognize it as a genuine marriage thus allowing you guys to apply under spousal sponsorship. Completely irrelevant if Philippines will recognize it. Your applying to Canada not Philippines.

P.S I strongly recommend you read the definition of conjugal relationship on the IRCC website. Yes it's a tricky one but you must understand it before you waste your time and money on the wrong application.

Same Sex marriage in the HK is not legal too apparently.

Yeah, actually, I don't think that same sex marriage is legal in HK. Whatever they did in Hong Kong would not have resulted in a marriage certificate.

only Holy Uniion Certificate. I need to know how to write a statement of attestation for unable to live together. and I hope this application is gonna be ok

I can but the thing is my work is here and besides I am worried if I go back home for 1 year gonna affect on my Citizenship. I had it almost 1 year now
Once you are a citizen in Canada you have no obligation to stay in Canada.

Work is not an acceptable reason to not live with your partner for the purposes of a conjugal sponsorship.

thanks for the your advise. Actually, I need some opinion for that. if I have to wait and see what will happen to her application then i will go back home to stay for 1 year or should i hold on to the application for now and go back home. the only thing is, i have to be stable if I am going to push the application after.
