Hello,

I paper delivered my PGWP extension in June 2019 (before PGWP expired, LMIA exempt, inland). I know PGWP can not be extended but what I need was just another couple of months of valid Canadian working experience, which the implied status will do.

I know it will be rejected but I haven't get anything official from the government yet. It's been over 6 months now!!!

Anyone knows what needs to be done since it's paper delivered?? And I'm very concerning if this no result thing will affect my PR application in the future? PLEASE HELP!!!!!

THANKS GUYS!!

Note that as you didn't qualify for an extension, you submitted an incomplete app. This means it can be rejected as incomplete, rendering you out of status as of your PGWP expiry and making all work done since then illegal.

I have read about rejected as incomplete on the official website but I thought that is for visitor, isn't it? And doesn't the incompleteness mean not paying fees or insufficient info that type of things? https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/visitors/implied-status-extending-stay.html

As for foreign workers, the site says: "Can I keep working if my permit expires? Yes, if you applied for a work permit extension before your work permit expired, you can keep working until a decision is made on your application." https://www.cic.gc.ca/english/helpcentre/answer.asp?qnum=189&top=17

Also, one of the IRCC reps told me that PGWP cannot be extended but it can be changed to open/closed WP. So on the WP extension application I indicated I'd like to apply for a closed WP with LMIA exempt. However, I still haven't heard anything from the government.

No, it isn't just for visitors. It applies to anyone who submits an incomplete app, which means an app is missing something required to be processed. You required an LMIA to apply for another work permit. You submitted an app without an LMIA, therefore it is incomplete.

That helpcentre link is based on the assumption that people who apply for extensions ACTUALLY qualify for them.

You don't qualify for an LMIA-exempt work permit, so you still submitted an incomplete app.

Altho it's not only for visitors it also indicates in the same website that "If a temporary resident applies for renewal of their work or study permit and their permit expires before a decision is made, paragraph 186(u) and section 189 of the Immigration and Refugee Protection Regulations (IRPR) (the right to continue working or studying under the same conditions pending a determination of their application for renewal) apply only as long as the person remains in Canada.", which I understand it as you can work legally before receiving gov's decision if a work permit renewal has been submitted.

My company provided me with LMIA-exempt form and I attached on the application. Will that make my application complete then?

Again, on the basis of actually submitting a complete app. If the decision is rejection as incomplete, Implied Status never applied.

How is the job LMIA-exempt?

I haven't received any decisions and it's been over 6 months.. that's why I wonder if there is anything needs to be done to know the decision.

I asked the company for LMIA but they could only provide LMIA-exempt. That's then what I used for my app. So how should a job be LMIA-exempt?

And if the app requires LMIA-exempt and I have one, then no matter if my job is LMIA-exempt or not, the app should not be considered as "incomplete", correct?

No, if your job doesn't qualify as LMIA-exempt, your app is not complete.

but how come I still haven't heard anything from the gov yet? Do you by any chance know what needs to be done so that I could get the result sooner?
Work permit apps are delayed right now. There are many threads about it. There is nothing to do to speed it up.

So based on my 10 month NOC B work experience (if those 2 months of work doesn't count), plus one year overseas work experience. Any recommendation on some methods of getting a PR? (I'm currently not in Canada)

I think that they now have many student visa's to handle because many students are coming from overseas to start their studies in Canada between 7-15th of January. I guess there is a slight delay in all visa applications.
