I have a query. Me and my husband are applying for canadian immigration and my husband is the primary applicant. My husband’s sister is a canadian citizen but she has recently moved to USA. So my query is that now we will not get 15 points for her? However my brother is a canadian resident as well, and he lives in canada so will we get 15 points for him?

No, the sister should be in Canada. Aside from proof of relationship with the sister, they would require proof of residency in Canada for the sister.

You can't get the points for her. If your brother is a PR, you can get the points for him.

She will get the points If she will apply as the primary applicant. The husband has no blood relation to her brother.

Incorrect. Points are given for siblings of accompanying spouses.

Points for siblings in Canada

You can now earn 15 additional points if you (or your spouse or common-law partner who will come with you to Canada) have a brother or sister who is:

• living in Canada and
• a citizen or permanent resident of Canada

To get these points, the brother or sister must also be

• 18 years old or older
• related by blood, marriage, common-law partnership or adoption
• have a parent in common

You can get points for your brother as long as you are listed as accompanying in the application.

No points for the sister since she is not living in Canada.

15 points total. You can only claim the points once.

I am the primary applicant, my sister in law (primary applicant) has a PR but she moved to home country now, but her husband who went as an Accompanying spouse is still there. In that case can the sibling points be claimed?

EDIT: Can you clarify who the sibling is? Is the husband your brother? Is the sister in law your spouse's sister?
