Hi everyone! I am a newbie here and I am so glad that this forum enables those who wants to immigrate to share information and experience with each other!

Does anyone have the answers...?

1. My husband is an interior designer who owns a limited company. But he hires nobody but himself. If he pays himself monthly salary. Is he eligible to apply as a self-employed?

2. I heard that points in self-employed program are not critical (as long as you got >35). But it depends on the subjective judgement / preferences of the officer. Is that true?

3. If we fail this self-employed program, will it affect the chances of other immigration program, say, PNP?

No there's no requirement that you HAVE to be self employed when you land. There's no process to follow up on that. I have only held salaried jobs since I got here. That shouldn't worry you

Also yes you can also have a concurrent Express Entry profile

The points matter and application is considered based on satisfying the criteria for the stream not preferences of officers.

You should be able to apply for other streams you qualify for if you are rejected from the self-employed stream.

Does anyone have a sample for the narrative document for accumulation of funds for a self-employed persons? I found a guideline for the investment visa in Quebec, and it includes tables and passages of text the narrative document must contain. Does this also apply to the narrative for self-employed individuals?

How do you advise I structure the document, for instance, Many thanks for any advice.

I'm in the midst of gathering documents. As I'm a music teacher, my clients are students. Any thoughts on how I can prove work experience if payments are made with cash? Don't think reference letters would hold much weight. Would appreciate some advice. Thanks

it was last week and now I’m just waiting to see if the “responsible office” contacts me back to see if there is any update they could give me.

I also ended up going to a lawyer who told me that CIC basically doesn’t care much about self employed applications and are last on their priority list, also that they only post “estimated processing times” but that is not something they stick on, which I kind of feel like he just wanted me to go and apply again through another program which he was offering his services for. But at the same time, my application was supposed to finish back in Nov 8th and it’s taking longer, so I don’t really know what to believe now.

Right now I’m just waiting and thinking what I should do, as my work permit expires on May next year and I can’t really afford to keep waiting and waiting to see “what would happen and when”.

Oh thank you so much for your answer, I really hope they have some updates on your application, Which email address did you send the email to? I really hope you get a positive response, don’t trust too much in lawyers at some point you have to get an answer, I totally understand about your visa situation and I am in the same boat my visa expires in June and I’m already thinking of the plan b and I might wait for the answer outside of Canada as I can’t afford to stay as a tourist! If you have any news about your application please share this is so important in this process! Stay positive!

Best Way to prepare SELF EMPLOYED PERSONS File

Let me share my story..

Here is the summary of my application status.
I submitted my file under self employed artistic category. I didn't have university degree. All I have a diploma from private institute. After one year of the AOR, I had to appear for an interview which lasted for 50 minutes and felt like interrogation. I was not sure about the result but on next day, they sent me medical request and prearrival service document. I passed the medical and now awaiting for passport request.

They gave me one month of period prior to interview date. So I had plenty of time to prepare. Since I had no information whatsoever on wht basis my application judged and what kind of quesstion I will be asked, I decided to visit Canada Federal Court webiste and went through all the rejected cases under the Self Employed Category. I wanted to know the mindset of the visa officer. I wanted to know the pattern of rejection, on what basis they reject the application, what kind of questions are asked and preparations are expected from applicant. After goiong through almost 25 court cases, I understood assumptions based on which they make judgement. I'll try to point out all the assumptions of visa officer.

What I am suggest you is to go through each and every case and study the argument. What Visa Officer is giving reason of rejecting the application, and how can you make your application stronger prior to submission.

Why this step is important? Because passing eligibility is crucial step. And it is decided by Visa officer. And there are no concrete guidline based on which visa officer make their obsevation. So, once you go through these cases, you'll understand how they judge the file.

The assumption of visa officer

· If you have never operated business in past, then you will not able to operate in future.
· If you claim, you will collaborate with other people, you must show the proof that you did it.
· If you don’t know English, you cant settle.
· if you have no evidence to back up your claim, your claim is false.
· Applicant need to be truthful about any parallal employment
· Market research is important factor.
· Source of funding must be yours and you must able to use it anytime.
· Business plan must show that how your business will add significant contribution to cultural life and Canada and its economy.
Even though you have experience and won awards, if you have no knowledge how you are going to establish yourself in Canada, then your file will be rejected.
Your experience and intended business should be in align. You must have business experience of proposed business. Your business must impact artistic or cultural life of Canada.
· Information in your application should clearly demonstrate that your intended activity would make a significant contribution to specified economic activates in Canada and it would also enrich culture or sports of Canada.
· You should have paid taxes.
· You need to establish history of fund accumulation by your occupation.
· If you are receiving job salary, then you are not self employed
· If you are only stick to one institute for work and not doing other project out of the institution, then you are not self employed
· If salary is the sole source of income, then you are not self employed
· You must provide detailed research, includes cost of intended business.
· You need to be aware of existing competition, labour market and wages.
· You must speak one laugnage out of two of Canada
· Must include Canadian as a part of economical or cultural activity.

Oh dear. I'm a music teacher, can't say I'm world class, you mean we need to fulfill both criteria? Self employed experience and world class? I read some of the rejected cases. And what if my experience is based on teaching in this music school for 8 years? Then it's not considered self employed? But if I'm a music teacher, I shouldn't be expected to keep switching right? Then I'd be dumping my students halfway through their years of learning right? So confused now. After reading, I'm not even sure I qualify as self employed. Can someone throw some light?

if you were receiving a purchase order and sending your employer an invoice and were not on their in-house payroll and paying/processing your own taxes then you were self employed.

the issue of World Class is subjective. if you were teaching at a prestigious location or tutoring and producing world class performers then that might sway their opinion. if you're teaching toddlers in a village hall for 8 years then not so much...
