Hello guys
a quick question, My reference letter also gives me number of hours I worked during Dec 2012. but it does not show how many hours I worked per week even though I worked more than 30 hrs. when I talked to HR they say we cannot write this. but I can show my pay stubs for the last one year. HR also suggested that. Do you guys think this will work as I am proving my point that I worked more than 30 hrs by showing pay stubs.

Cic now see 30 hours per week as full time. If for example you worked 40 hours per week, it would make no difference to your application, as 30 hours is the maximum you can claim for any given weeks work.

There is no need at all to supply pay slips as long as your t4's cover a 12 month period of valid employment.

To iterate, as long as it stated you have 12 months / 52 weeks of full time employment, at least 30 hours per week. You are fine!

CIC will still want "hours per week" in the letter. Try and request it by email, if they refuse you will have the response in writing and can submit that as evidence.

I would agree that the T4 (if you have it already for 2012) would provide evidence of total number of hours worked, but it can't provide information on hours worked per week. So in this case, photocopying your paystubs would be important.

(Or, if you no longer work for this employer, you could also submit a copy of your Record of Employment).

HI JES ON PLEASE HELP ME OUT IN 2.5 YEARS EXPERIENCE ONLY 4 WEEK I DID NOT WORK MORE THAN 30 HOURS BECAUSE OF COMPANY BUSINESS WAS DOWN AND THEIR WAS NOT WORK AND THESE 4 WEEK NOT CONTINUOUS MEANS IN 1 ST YEAR 2 WEEK AND IN SECOND YEAR 2 WEEK. BUT I WORK CONTINUOUS AND MORE THAN 35 HOURS IN WHOLE 2.5 YEARS AND MY TOTAL HOURS 4000 HOURS WORK IN 2.5 YEARS CONTINUOUS WITH SAME WAGES AND BENFITS ON LMO BASE WORK PERMIT. SO IS IT CIC NOTICE NEGATIVE PART IN MY WORK ELIGIBILITY

the email is def. good to have! it gives you a fair reason why you couldn't provide the letter!

Hello,

Just to be sure, I av a reference letter from 2 of 3 companies tht I worked with. I have gained more than 1 year experience with 2 of the companies that provided a ref letter but the last company for 5 months refused to give a reference letter cos i resigned. do u tink tht can cause a rejection even though i av reference letters for 2 places (>12 months) I have worked with........

There is nothing "negative" about part-time work or breaks in work, both are permitted.

Please read the document checklist. Near the top of the first page, there is a note that instructs you to provide a written explanation if you are unable to provide any of the required documentation.

If you qualify even without this, it should not cause any problems. But you still need to document it with a written explanation, include the details required in letters of employment. Since you no longer work for that employer, you should be able to get a Record of Employment to submit along with your written explanation.

1. Will the absence of contact info be an issue? Should I mention this fact in LOE?
2. I will be able to attach the email extract which also contains their Contact number in their Official Signature. Should this suffice?
3. Should I attach email mentioned in Point 2 in LOE or the respective Employment History or Both?

You can attach the copy of the email that you sent to your company asking for the letter including the contact info

Hi All,

I am currently working in Canada since March 2019 under the closed work permit with a positive LMIA. In the job offer received, there is no end date provided. But the following lines are stated.

"You must provide proof of valid work authorization upon the commencement of employment. If required, you must obtain Canadian Permanent Resident status at your own cost within the term of your work permit. If you do not do so, or if you become ineligible to work in Canada for any reason, you will be considered to have resigned voluntarily from XXX. Once you obtain your Canadian Permanent Resident status, you must provide HR with a copy of your Permanent Residence Card and your new Social Insurance Number."

I have two questions:

1. Do I still need to show a valid job offer letter with a mandatory statement "this job offer made is valid for at least a year from the date I become PR"? My HR or manager is not providing such a document. But my work permit is valid till Feb 2021. Can I attach LOE and get the 50 points for a valid job offer? Because the job offer made is LMIA approved.

2. I have 7 years of experience in total. Back in India, I worked for NOC-2174. However, my job offer and LMIA was made for NOC-2175. In primary occupation, which NOC should I mention?

Since I recently moved to Canada, I have only 9 months exp in NOC-2175 and 6 years exp in NOC-2174. When I put the NOC-2175 (the one I am working here), the profile becomes ineligible.

Please help!

Since I recently moved to Canada, I have only 9 months exp in NOC-2175 and 6 years exp in NOC-2174. When I put the NOC-2175 (the one I am working here), the profile becomes ineligible.
You have not yet completed a year of work experience in Canada, so you are not yet eligible for consideration under the Canadian Experience Class. After you work for a year in Canada, you will be able to use any NOC for which you have experience in Canada.

As you may currently be eligible under the Federal Skilled Workers (FSW) program, there is a requirement that you have at least one continuous year of experience in a single NOC, and that you chose that NOC as your primary occupation. If you want to qualify under FSW, you will have to use NOC 2174.

This is difficult to answer with any certainty. Since you are already working in Canada, this is the set of rules that applies:

"if you’re currently working in Canada in a NOC 0, A or B job on a work permit that was issued based on an LMIA, and:
  • you’re working for an employer listed on your work permit
  • you’re authorized to work in Canada on the day you apply for a permanent resident visa, and when the visa is issued
  • your current employer made you an offer to give you a full-time job for at least one year if you’re accepted as a permanent resident"
The OLD job offer you received does not really meet that requirement. In fact, it is quite vague.

"If required, you must obtain Canadian Permanent Resident status at your own cost within the term of your work permit."

There is nothing stating anywhere that it is required.

From my POV, this does not meet the requirement of a valid job offer. However, some people have gotten points under similar circumstances, others have not (and they been refused because of it). There is nothing stopping you from trying, but it will be a gamble.

You will gain a significant number of points after completing one year of Canadian work experience (try the calculator with and without one year of Canadian experience). My suggestion would be to wait for that.
