Hi!

I am in a little peculiar case and was hoping if someone can share their thoughts on it. I have applied for Express Entry PR with my wife as secondary applicant. My wife is currently with me here in Canada on her student permit.

My wife's student permit expires on 31 December 2019 and she is eligible for post grad work permit. Now, I am not sure if we should apply for her post grad work permit or wait for decision on our PR application. She is currently working full time after completing her studies. Will her being a secondary applicant also give her an implied status to be legal in Canada or should she apply for her post grad work permit.

I don't expect a decision on our PR before her status expires. We applied on July 29. It seems application is in IP2 but based on some research here on forum nothing can be said for certain about when they are gonna take final call on our PR.

Any help is much appreciated.

1. A PR application does not give you legal status in Canada. In your wife's case, she needs to apply for PGWP before her study permit expires.

2. If your wife has already completed her study program and graduated, she can NOT work unless she has already submitted an application for PGWP. If she's working now, she needs to stop immediately. It's illegal.

As said above, she is NOT allowed to work full-time after completing her studies until she applies for a PGWP. She is allowed to work part-time after completion until she receives written confirmation of her program, at which point she is NOT allowed to work at all until she applies for her PGWP.

She needs to stop the illegal work ASAP.

Thanks a lot guys for replying. I have just talked to my wife about this and she is doing only 20 hrs a week at this point. She is aware about this constraint.
She has not yet received letter of completion which she says school will start issuing this week.
I have also done my research on cic in meanwhile and have understood that PR application doesn't give implied status. I'll make sure we apply PGWP as soon as she gets letter of completion which hopefully will be somewhere this week and stop working after the letter is issued.
