Address with US employer and starting residence in Canada as PR

Hi All,

I have gotten PR and landing is also done 1 year back. Delayed move to Canada due to some family issue. I am planning to move now but my work is going well in the US and employer is also somewhat flexible(currently on H1b). I thought I can start weekly commute (In before Friday night and out after Monday morning) and gain 4 days a week. After a coulple of months, I can ask for remote work or less commuting. There seem to be a lot of people doing that already and have also seen posts here on the website aswell.

Below are my questions

1. Do I need to make any change in payroll address if I am doing weekly commute? He wont see any difference in my working time and days.
2. If yes, Do I have to give a Canada address or US address? Since I am planning initial weekly commute, I do plan on renting a shared room in US to stay for the week. (He definitley will be uncomfortable accepting a Canadian address and having to deal with international tax issues. I would rather prefer I give him a US address)
3. If I do give him a US address, would that make any difference in my Canadian citizenship application later? In the sense, would they mind if I am claiming I lived in Canada but my pay was being made in the US?

Yes you can fly out weekly on your H1B. You would need to use your US address for your employer. You may not qualify for Canadian healthcare coverage with your arrangement. You will have to look at the residency requirements to qualify for healthcare in the province where you live on the weekends. Moving to Canada and working remotely is definitely possible. To maintain your RO you likely won’t be able to do it for 4 years. How you need to structure your remote work arrangement will depend on your employer. As an H1B you normally need to have a US address.

1, 2. No difference but an address you use should be based on your primary place where you stay - a common criteria. Issues on residency will come up while applying for loan, health card, credit card etc. So its all about what you would want to get done at the canadian side.
3. For citizenship, they expect you to have had the residence in Canada as primary/permanent location and should have filed tax as a resident. Filing non resident or using some other international address will show that you did not make Canada a primary and permanent residence.

FYI - I dont have US address in any of the places, including uscis, payroll etc.
I file using Canadian address for uscis/visa. As i am at the border, its not an issue but it wont make sense if people's work location is not closer to the border(uscis expects the residence should be closer to work, per rule, if not they sometimes issue RFE).

For the purpose of US employment, tax withholding and immigration, you need to use US address.

For Canadian residency obligation and subsequent citizenship application, you will show the evidence that you have lived in Canada for whatever duration you claim. The two residencies are independent.

You will have issues accessing health care for sure because of your residency pattern. Assuming that you will work from Ontario, you need around 150 days of residence in first six months of a year. After that you will have flexibility to travel as long as your primary residence is in Ontario, but in first six months you could be out only for 30 days.

Also, you need make sure you will meet RO. I am not sure how much time is left in your PR, but 4 days a week means you can get only 208 days per year (52 weeks / year), and you will need to have at least 4 years to meet the cut off of 730 days to renew the PR. You might also be needing some days to go to India and all that. It could end up very tight..

You should ask for better arrangement like flying in Tuesday and flying out on Thursday. Friday majority of them are anyways remote and you are just requesting one additional day on top of it.

If there were any issues with the H1B, I and a lot of other people of this form wouldn't have asked questions about commuting on this Visa.
