hi guys please help i m in trouble very tense somebody please help.

my wife is on student visa and she is three months pregnant. i have applied for open work permit and i forgot to mention previous refusal letter and they said you have failed to disclose complete answers in your statutory questions. namely your refugee claim in the country of Australia.Explain why this information was not provided and provide copies of documentation you have to support your response, which may include copies of refusal letters or other correspondence. i am concerned this misrepresentation was liable to induce an error in the application of the immigration and refugee protection act. they ask me to respond with in 30 days. so my questions is will there is a chance of get banned for five years. they have mention the rules of misrepresentation in the letter which made me worry a lot. so pls help me
please help very tense.

You need to respond, confirm that you were in fact refused in the past, provide all of the details regarding this refusal, and apologize for making this error in your application. You should also explain why you failed to declare the refusal.

Yes - there is a chance you will be banned for five years from misrepresentation. There is also a chance they will just refuse you. There is a very very small chance your application may be approved - however this is less likely.

Would mention that on top of that SOWP are not guaranteed for spouses of international students. Given your previous refugee claim you may struggle to be approved if you aren’t banned. Forgetting about a previous asylum claim is a big omission.

You are very unlikely to avoid a ban in this case. Failing to report a previous claim for refugee status is more serious than failing to report a visa refusal.

Note that if you are banned, your wife will not be able to apply for PR while the ban is in place.

Did you deliberately omit the previous asylum claim in Australia? If so, was it because you withdrew the claim, or were you refused?
